Got a mail from USCIS in nov,2007 stating that our case is transfered to NSC from TSC for faster processing. No update after that except couple of LUD's after FP in Feb, 2008

These are the reasons
(1) Employers will have ability to pay issues or just do not want to carry paperwork after you leave - cancelling 140 is beneficial for them - they win the goodwill of USCIS
(2) For USCIS - handling AC21 paperwork means assigning an IO and time and resources - without any fee associated - it is easier to send denial and get money through MTR so that the IO can be working on your case as "billable work" and not "free work"
(3) The intent of long duration standards set by USCIS is nto make immigration difficult and not easy, so when one changes job using AC21 - with no process in place - it is easy to mess up things rather than fixing them.
(4) In reality - in a perfect world - there is no need for AC21 regulations - this is just a provision for cases where there are long delays - so I doubt if this process will be officially handled through forms and fees and procedures - USCIS handles this only through memos and IOs have their own way.
Please participate in the AC21 campaign and lets make it a success. We have to stop seeing denials and start seeing atleast RFE or NOID

SLowhand, You are absolutely right. We can understand if USCIS does not send anything to employee for I-140, but for I-485, which really is an application from the employee, it is really not legal for the attorneys to dance on employers' tunes and provide our paperwork to them and then blackmailing us together.

People: I called up a doctor in NJ and the next appointment date was 1st August. Then I tried few more numbers and ph just kept ringing. Finally I called up a doc in NYC and got the appointment for this Friday (June 18). He charges $190 per person. Here are his details.

From what I know TN visa is not dual intent like H1B. So you can't continue processing your GC when holding a TN visa.
Changing citizenship does not affect how Priority Dates are recaptured (aka pd porting).
Once you are Canadian citizen, you can also avail TN visa (in addition to H-1B) to work for US employer.

See the audit questions again, all relate to justifications that the requirements are really needed for the job advertised. ie. when the job ad said MS+2 Years is needed, DOL wants to know why this job requires MS+2 Years of experience. His lawyer is right, a more conservative approach to job requirements (MS+0 or BS+5 for EB2 is much more easier to defend). As you increase the minimum job requirements, it reduces the pool of available candidates who can apply for the job. DOL wants to make sure the minimum requirements are really valid, and not set artificially high simply to reduce the pool of candidates.
Basically your LC sponsor needs to be able to justify all requirements posted for the job (education, experience, specific skills) else you can be in trouble.
Yes audit questions seem to be hinting screw up from employer side but then also it can not be judged exactly on the same line without going into detail of provided job classification, job requirement and furnished docs from employee.Now all of the areas you mentioned are crucial from employer side and in addition to that "employee's degree" evaluation is also done at labor stage,(PERM or OLD LC). In Minnesota, the driver license is usually valid for 4 years. But for non-citizens (and GC holders) they print a red colored status check date. And the validity of the license is then until the validity of the visa. In most cases for those under retrogression it would be anual renewals of the driver permit and the validity date coinciding with the EAD validity.

I would put this News letter in one of the 'Most Informative' ones. It clear doubts about maintaining H1B/EAD it talks about changing jobs on AC21. Intresting to see that 3 years EAD/AP thing as well as he mentions about the combined EAD/AP document. Attorney Ron Gotcher is also very proactive on his forums, you can ask specific questions, he usually answers it the same day..

I don't know much about Canada PR, but the 2nd option sounds good to me. Make sure your new employer is willing to give you a Joining Letter with the similar job responsibilities, job title, etc upon which your 485 is based.

Anything less than 800,000 is good... even a few hundred thousand less :) There's still a lot of work and patience required but a good news is a good news nevertheless.

My file is also sent to des moines IA. been there since june 08.
PD is current for a while. no updates yet.
On July 21st, 2008 my case was transferred to CSC where they are not even processing any 485s. I waited to several years for PD to become current and no sooner did it became current, it was transferred to a black hole. I got different versions from customer service/Io and info pass persons as to where the case is. The reality is that I do not know where my case is right now. The website still shows that it was transferred to CSC.

H1B is a fallback in case I485 is denied. Kumar - you may need to check with your attorneys or an independant attorney on immigration law.
