    This is my new employer asking me sign this document called "time sheet agreement"...would it stand in the court of law, say I left the job and could they come after me with this paper?

    here is the 80% of whats in there with company called (name changed) Nathuram-daulathram-desi-Company :D

    If the employee wishes to terminate his/her services with Nathuram-daulathram-desi-Company, he/she agrees to assist Nathuram-daulathram-desi-Company in fulfilling the contract terms that Nathuram-daulathram-desi-Company signed with client like notice period etc. The client peanilizes Nathuram-daulathram-desi-Company if he/she leaves the project abruptly without sufficient notice.     Employee agrees not to transfer billing to another firm and / or accept payments from another firm or the primary vendor or mid vendor for the project you are currently working will be working in future.     Employee is responsible for the accuracy of the time sheet submitted for payroll. If Nathuram-daulathram-desi-Company pays you and we did not get the money from the client, he/she are responsible to reimburse Nathuram-daulathram-desi-Company all the amount that is under dispute within 5 business days. Employee is responsible for all the legal and administrative costs (attorney, collections etc) for enforcing the above terms. All disputes will be settled according to the laws of the sate of NJ.

    Employee agrees to reimburse Nathuram-daulathram-desi-Company any and all over payments made to you within 5 business days. If you fail to do so, then the employee agrees to pay the legal costs involved in enforcing the same.

    The above costs are difficult to calculate and will be based on our approximations.

    99% agreements written by the desi consultants are not legal ( they are one sided) . if you dont sign it , you dont get the job.

    * Call for full funding for law enforcement and security along the southern U.S. border, enforcement using "cutting-edge" technology, better coordination with law enforcement agents and construction of a federal correctional facility to house illegal immigrants convicted in state courts as well as reimbursement to states for incarcerating illegal immigrants.
    * Request full funding for processing employment-based visas; eliminating visa-request backlogs and increasing the number of visas to meet U.S. industry needs, especially in high-tech, bio-tech and seasonal-based industries.
    * Establish a guest worker program that will include background checks to help supply workers where there are shortages.
    * Enforce sanctions against employers for hiring illegal immigrants along with a system for employers to verify citizenship and worker status.

    What are you going to achive by knowing about US citizens..???
    If they make a rule wherin US born child parents should be given the US citizen ship, hands down I can say immigrant will make use of this rule efficiently.:D:D:D:D:D

    right. Either way one has to go through Labor pains. Atleast in this case the case is processed within 9 months, we dont have to keep waiting and looking for Visa Bulletins.

    Also, I am sure in this case no one is going to try LC-substitution.

    In addition, no one is going to agree to file a case as a 'future employer'. It will only be filed once the employee really commits to the sponsor.

    This is how it should be done...

    - request USCIS to port your PD from already approved I-140 from past employer
    USCIS may or may not do it for you

    - if not apply for I-485 using Category of 2nd (should be EB2) and PD from 1st one. You need to attach both of these with I-485 application and of course a covering letter stating what you are doing.

    Here is the extract from the law -

    QUOTE
    (3) Priority Date Based on Earlier Petition.
    If an alien is the beneficiary of two (or more) approved employment-based immigrant visa petitions, the priority of the earlier petition may be applied to all subsequently-filed employment-based petitions. For example:
    Company A files a labor certification request on behalf of an alien ("Joe") as a janitor on January 10, 2003. The DOL issues the certification on March 20, 2003. Company A later files, and USCIS approves, a relating I-140 visa petition under the EB-3 category. On July 15, 2003, Joe files a second I-140 visa petition in his own behalf as a rocket scientist under the EB-1 category, which USCIS approves. Joe is entitled to use the January 10, 2003, priority date to apply for adjustment under either the EB-1 or the EB-3 classification.

    Disclaimer -
    I am not a lawyer and this is not a legal advise. You may want to talk a immigration attorney for exact interpretation



    Now why I suggested you yesterday not to do it -

    2nd option - may seem like you would be adjudicated using PD from 1st and Category from 2nd (EB2). But this is what USCIS is telling me know-

    we would approve your application if either of these PD gets current in their respective categories.

    I am in a similar situation. My I-485 is pending, was filed in July, 07. My PD is June, 04 (EB2 India). I-140 is approved. I have to leave the US for a year to work on an expat assignment beginning last week of December, 07. I have my EAD and AP. Also, I am on a valid H1-B until May, 2008 but will be applying for an extension until May, 2009.

    Please let me know your thoughts if it would be ok for me to leave the US for a continuous period of one year while my I-485 is pending? I plan to renter the US on H-1B and not EAD/AP.

    Also, from the previous post I understand that one needs to be present in the US to renew EAD and AP. My EAD and AP will expire in September, 07 but will I be able to renew them when I am back in Jan,09?

    For the period I am gone, do I need to pay any taxes on my foreign-earned income if I am going to a jurisdiction with which India has a favorable tax treaty? If my I-485 is pending but I am not working in the US, I do not need to pay taxes for the income earned abroad if I do not meet the "substantial prsence test" (183 days)?

    Any thoughts will be much appreciated.

    I received receipt nos. from CSC. Later i received EAD also. Today i received mail from USCIS stating that my case is transferred to Nebraska. :(

    Did you get a receipt notice and transfer notice for your 485 ( i got my EAD and AP and only got a transfer notice for 485)?
    Does anyone kn ow if the 485 receipt is required tog et FP notice?

    Also, my 485 receipt has a receipt date of august 28, but I am a july 2nd filer..does anyone else here have the same situation?

    Thank you for your information.I hope you know the situation right now in USA.In jan 2010 H1 people came to Newark Airport were asked to form in a separate queue as soon as they get down from the flight for two levels of interview.Some of them are sent back.Now you can't find employer to transfer your H1 immediately.Before two years it was possible to transfer H1 with out having recent pay stubs and they never asked client letter.Now if you don't have a job you can't transfer your H1 to anybody.
    Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

    I am in a similar situation. My lawyer prepared the following letter which seems much simpler than what you had mentioned. I hope, its helpful. However, my company HR is not willing to even sign on this one. they omitted the word 'permanent' and also, removed the last sentence mentioning that i will continue as full time employee after receiving the green card. I regret joining a big company now. But, we are where we are and have to deal with it.

    That happened to a person I know, she was an undoccumented immigrant or illegal and when facing deportation the judge said he does not think having a US born child was reason enough to grant residence in the US. The child can always come back when becomes 18
