yes finger printing is not required, mine was issued recetly without FP. You can take a chance and send the photos. At the most they will ask for it again.

Thank you all for providing some excellent information. Special thanks to members waitnwatch and fromnaija for providing Arizona specific information. I certainly think that I should take this further in light of all the new information. I even talked to my GC attorny and he also thinks that I should have have given resident status.

After you have filed for labor or filed for 140 or only after filing of 485? Those 3 dates could be years apart and depending on how the university defines that you have filed for GC could determine the residency status. If you have any further information, please share.

Jamaica does not require visa for Indian citizens, regardless of US status. One of the very few countries where Indians can go w/o visa along with Thailand and Hong Kong.

keep records of all the facts. create a file to gather all the facts to demonstrate that the job was eliminated due to the downturn of the business. you need to have good faith intentions to join the sponsoring employer. if you have those and then still couldnt work for that employer due to the things beyond your control, then there is nothing anybody can do about it. so enjoy your days and dont worry about the future. just be prepared with necessary documentation that you need to do for the citizenship...

The question is, does this spoiled my chances for citizenship?

Got following email today on my daughters case today. NSC July Filer. EB2 I Mar 2006.
All our cases show this status now.

The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done, counting from when USCIS received it. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. To receive e-mail updates, follow the link below to register.
Where in the email does it say that the case has been transferred to a "LOCAL" USCIS office? From your information it appears that you are a July 2007 filer. Please check your 485 receipt number, if it starts with anything other than LIN, it means that although you mailed your application to the NSC, they sent your packets to either CSC or TSC for data entry. Now that your PD is current, it is quite possible that this office is now sending your packet back to NSC (which has jurisdiction) and is now pending there.
I say this, because, the same thing happened to me and many others whose 485 submissions were sent to difeerent offices for receipting and then those packets were sent back to NSC.

We entered US in May 2007. My wife's visa stamp was expiring in Nov., but her H4 Visa was expiring in April 2008.
The Customs officer put date valid till Nov. 2007.
I went to US Customs and border protection office and showed them the original Visa. They asked to fill up new I-94 and stamped it with April 2008 Date.

You will need to bring the questionable I-94 or I-95 Form and documentation to support the claim that the form was not properly annotated. For example, present a passport and visa to justify an incorrect visa classification or an approved petition to support an incorrect admission period. A fee will not be assessed.

Hello,
So yesterday (Saturday) was another surprize, a pleasant one again! I got a call from the same IO who told me that he got all the documents that I had sent and has cleared my case for approval, but now my fingerprints have expired.
He asked if I could come right away to his office and he could give me an instant fingerprinting appointment in the nearby INS office. When I told him that I'm currently out of country on business trip and won't be back in US till April, he said he will send me an appointment near April 15th.
I thanked him for his follow-up and he said he was just doing his job. I know this might be an exception than a rule, but just wanted to acknowledge this particular IO and hope there are more like him.

If IV core can help us to set these meetings up and also provide suggestions/ideas, I think with 50 participants, we can convey what we want to. If EB2 folks are also joining us, we can seek support from compete America and have representation from them as well.
We should keep this very low profile - meaning:
1. No high demands - shouldn't ask to make EB3 I current in October
2. Shouldn't compare or discuss EB2 I and C
3. Shouldn't complain their (USCIS/DOS) work style or inefficiency.
4. Don't compare us with illegals.
What we should be discussing:
1. Reference to EB3 I 2001 and 2002 cases and possibilities with new VISA flow structure
2. Difficulties in using AC21/EAD to switch jobs
3. Very importantly - how they view EB3 I dates not moving forward in the last few years (besides last july) and what their plans are to address it (besides passing a legislation)
4. To give us some direction in planning for the GC wait - by providing us how many cases are pending with break-down year wise - will indicate that people can make their own decision either to continue GC process or give up and go elsewhere (we will not demand GC but seek information to enable ourselves to make a wiser decision)
5. Their game plan if a legislation does not pass, say, for the next 2 years. Can they make some changes at administration level to help us? Like relax EAD restrictions?
These are not high demands but fair enough questions from aspiring immigrants who are in the queue as long as 8 years!!
We will send letters to President, Immigration sub-committee, DOS and USCIS chief, CHC members either before or immediately after the meeting.
The intention is not to come back with GC for every EB3 I but atleast make a representation and seek some quality information from them. Also, give them the feeling that we may not wait forever.

My friend Cyrus Mehta reports on a disturbing incident that occurred last week at Newark's international airport. Apparently CBP officers got hold of the new Neufeld memorandum on H-1B workers at third party work sites and decided to start applying it on their own. Aside from being contrary to established procedures for revoking visas, CBP officers made inappropriate comments and issued threats that cry out for some form of disciplinary action by DHS: It is then no surprise that the outrageous singling out of Indians since the New Year waiting in the line at Newark and other airports by CBP...

This means that even for applicants for whom PD is current today for eg: EB2 ROW, will not be able to apply for concurrent I-140/I-485, if this rule is accepted.
Due to the retrogession,we cant file 140/485 concurrently till PD is current.

Also is it too much to expect American mainstream media to totally NOT ignore Diwali which has significance for the second largest population in the world and instead publish significantly less significant story of the balloon boy?

I have similar situation - I applied for 140 in July 2006. My daughter will turn 21 in July 2007. As I have applied for 140 before she turns 21, she is safe for GC, but will loose H4 status when she turns 21. As per my lawyer's advice I have applied for her F1 so that she can stay and continue her studies in US. When I become eligible to apply for 485, she can be included in the application - but, not as a dependent of H1B holder.I urge you to ask for second opinion. From my understanding it depends how long your I-140 was pending.

Derivative Beneficiaries � Family and Employment-Based
In addition to the direct beneficiary family-based preference category examples provided in the previous memorandum and above, section 3 of the CSPA also applies to derivative beneficiaries in both family-based and employment-based preference categories. Just as with the case of the Form I-130, with an adjustment based upon an approved Form I-140, Immigrant Petition for Alien Worker, [and other immigrant petitions filed under section 204 of the Act for classification under sections 203(a), (b), or (c) of the Act], the beneficiary�s age is to be calculated by first determining the age of the alien on the date that a visa number becomes available. The date that a visa number becomes available is the approval date of the immigrant petition if, according to the DOS Visa Bulletin, a visa number was already available for that preference category on that date of approval. If, upon approval of the immigrant petition, a visa number was not available, then the date for determining age is to be the first day of the month of the DOS Visa Bulletin which indicates availability of a visa for that preference category. From that age, subtract the number of days that the petition was pending, provided the beneficiary files a Form I-485,3 based on the subject petition, within one year of such visa availability. I completely disagree..There is this huge debate in IV about EB2 & EB3 IN. Everyone is looking at the dates and predicting that EB2 I will be current sometime in '09. This is perceived as injustice to EB3. What people don't realize is that USCIS is not processing. What good is a forward movement if there are no tangible benefits for folks who have already filed AOS.
Forward movement in Sep VB magnifies the USCIS inefficiencies. Despite the rhetoric on the board, this is -ve development in my view. Empirical evidence suggests that there are 1000s of cases pending for pre 06 EB2I & C and yet USCIS could not get that back log cleared. They obviously could not process enough to exhaust the available visa numbers and thus the forward movement by DOS.
This bodes well for CP filers…good for them.
USCIS is trying to make EB2 all countries Current sometime during FY 2009. Of course "a few" 2004, 2005 cases will still be pending past Oct08 but hopefully not too many.
If EB1 and EB2 are shown as current soon, then the DOS can transfer the so-called "spillover" into EB3 ROW, then into EB3 IN & CH.
Based on available numbers, EB3 India / China will see rapid movement in dates April 09 Visa Bulletin onwards.
What will happen during 2009 in all likely hood is the following,
Almost all EB1 spillover will go to EB3. (~ 25k)
Some of EB1 and all of EB2 spillover will go to EB2 IN/CH (~ 10k to 15k)
In 2009, there will be no more Name Check delays - therefore expect rapid EB3 approvals after April 09.

Btw, I'm detecting some odd voting patterns such as a few entries suddenly jumping up in rank from votes from members who registered recently and have similar/identical IPs.
