Filed 485 during July 07. The receipt number was WAC*******, I got receipt notice and Transfer notice saying my case was "transferred to another USCIS center where it is currently being processed" but didn't mention to which center. I assumed it was TSC as I'm from NJ.
First EAD that I renewed in 2008 had RN as SRC**** and I got the cards with from address as Texas. I had sent the application to Dallas drop box.
Second (2010) EAD had RN as WAC******* and this time I got cards with from address as California.
I had assumed that all GC processing (485, EAD, AP) were being done from either NSC or TSC, probably not.
And I only had two changes to LUD, one during first FP notice in Jan 08, and another when I used AP to come back into US in May 09. Didn't have any RFE till now. Not sure if pre-adjudication triggers any LUD. If it does it would mean the case is not adjudicated which is hard to believe with the filing being almost 3 yrs ago. Does this sound normal (having the case worked in so many centers though I am NJ resident since 2005). What are my options in regard to contacting USCIS regarding getting latest update on my case.

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.
You didn't say any where in your message that TSC applicants are getting RN very late. Sorry to say but it seems you are very mean and selfish person. But looking at only NSC your concern is currect.

gc_chahiye, Thanks for your response. So, can I be on H1 with my current employer, A, and on EAD with my new employer, B, simultaneously?
Also, employer B might be able to start me on H1-B (my preference--just in case)--though as you said, B will have petition my new H1 for concurrent filing. My other option, of course, is to wait until Feb '08--though I'll miss out on a month's salary from B (not a biggie in order to not have any potential issues).

The Process of giving Birthright citizenship is a law called Jus Soli(14th Amendment) which was implemented in 1900's . Numbersusa and others are fighting to change the Jus soli to jus sanguinis which gives citizenship based on the child's parents Status to reduce the "Numbers".India Abolished Jus Soli in 1987 and dosent offer Birthright citizenship. I think going this Route to discuss the possibility to fight for parents naturalisation based on child's status will make us no different from Illegal Immigrants.

You can apply for extension. Fees are not applicable for extension of status. If it involves status transfer e.g H4 to H1, then you need to pay the fees. I extended my wife, and daughters status just by filing the paper work and got the new I-94.
I did a blunder by not renewing my passport and travelled to India in August 2007, while returning to US , CBP officer in Chicago issued my I94 only till the expiration of Passport , which is March 2008 . My VISA was valid till Jan 2010

I contacted my Lawyer on the situation and he suggested either to apply for I94 extension with CIS or travel to Canada . Applying with CIS with 300$ fee doesnt make much sense to me so I decided to fly to Canada and got my new I94 -- Yahoooo atlast valid till Jan 2010

Admin fix was the wrong thing to do anyways, else your Obama will create 101 rules that affect everyone, the check and balance system is a good thing for US
Admin fix should happen for small regulations not a big law like the CIR.
If administrative fix was the wrong way to go, then we are back to legislative fixes - and as I said earlier, boils down to meeting with lawmakers for us; and having the strength to meet with the media and push them to bring our issue to the forefront. Which ever way we have to look, our full throttled participation is a must.

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?
I have seen changing address triggered RFEs in some cases where an applicant moved out of state or even to a new city within the same state. In such cases, RFE was asking for proof of employment in the same or similar role.

My current EAD got expired by 08/27/2010 and I filed my extn by 07/06/2010. My check has got cashed by USCIS with in a week period of time. So I thought would get my EAD asap. But it didnt. Since my EAD extn filed to Nebraska Service center, called them on 1-800 and spoke with one of their representatives to expedit the process. I got a reply back from USCIS that they will expedit the process and the result should notifiy by within 30days.
I already in LOP, I dont know how long the process will take..? If anyone knows how could I do better, please let me know the details.
NOTE: Seems my priority date is also became current (Mar-30-2006). Would it cause for the delay..? Will they provide EAD and GC simeltaneously...? or Will I get EAD alon..? or will I get GC...?

When I was hired last spring, I was not told about GC retrogression by my employer. I beleive they should have explained in graphic detail and if they done so I would not have left a good job and my home in Canada to move to an American nightmare.
I recently discovered that I have at least a 5 year wait as an EB-3. My teenage daughter will be too old to get a green card as a dependent and my wife is seriously depressed about not being allowed to work.
How many other people are as P-Oed as I am and is there a class action suit here?
They are legally not irresponsible....They very well know what is going on....
They are the ones who designed the whole doggone system....
At the worst you can say that they are ethically wrong...
They have no obligation to explain anything to you...
In fact some would tell you to wait for two years to file for green card and they would be well within their rights...
For a class action suit you need a credible argument.
The way the law is structured...we do not have a very good argument..
If you do find good argument let us know..I am sure there are members who would be interested...
Also who exactly would you sue ?? People have tried suing USCIS already with not much of success...

The best recourse we have at present is through legislative efforts...

There are no EB2 positions available for the Software professionals, only EB3 positions are available. However as we discussed earlier if the company has a business necessity and are able to produce the documents for the business necessity you can file the case under EB2, which is still beyond the requirement according to Labor Department.
