Actions speak louder than words... Lou Dobbs says Microsoft has waged war against the American middleclass by taking the company to Canada. But that hasn't stopped the company from starting a development center in Canada, nor has the company cared to answer Lou Dobbs in a press release or anything. What I am saying is, we should not care about what Lou Dobbs thinks or says on his show. As long as we being here helps grow the American economy, nobody cares about what Lou Dobbs thinks!!!

You can file appeal your I-140 denial and based on the appeal, you can get your 9th year extension. As long as appeal is filed and pending, you can extend your H1B. This is what I heard.

Do you have your I-140 approved and if yes, have you passed 180 days since you filed your I-485? If answer to both the response is yes, then nothing to worry about as you can simply work on EAD.
If you are still considering transfering H1-B, start looking for a company immediately. Small India companies who do H1 transfer can be little helpful in your scenario but watch out for crooks.

Both have floor schedules and have issues that need to be debated on. the bill has to pass in both houses..either with the exact same wording or alternate text that will be reconciled in conference committee

It clearly mentions Hoyer in House and Reid in Senate. If nat23 had said why is Hoyer driving the agenda in house and not Pelosi? That would make perfect sense but how can Pelosi drive Senate agenda. My response was to that point. If you still argue that, I think you might need to clarify things at your end.
Also, the example you cite isn't appropriate to the context because both Indian Lok Sabha and the British House of Commons have a non-partisan Speaker. He resigns from his primary party as soon as he becomes the speaker. This is not the case in US congress, speaker of the US house of congress is a partisan leader. The implication is that Hoyer, even though a majority House leader may not drive the agenda and this connects to the point made earlier: Pelosi vs Hoyer not Pelosi vs Reid.

Yesterday, I felt proud to be part of a crowd that is so dedicated, selfless, hardworking, fearless, educated, discplined, understanding!!

To all:
I got my H1B stamping done for 8th year in Nov 2006. When I went to the officer, just before giving my application I told that I am a returning worker. He asked for the paystubs and I gave the original ones. He approved immediately.
I took all the documents as listed in the website as well as the vfs site.
Hope this info helps.

I dont understand, why in the world some one wants to take responsiblity if the client is not paying. As long as you submit your time sheet in time, you are done. Why one should take responsibility to collect and legal fees...come on..give me a break

The only person that makes sense on this thread is ramaonline. Javadeveloper, since you've filed your AOS, you'll be in legal status with or without a job. You don't even need to have a job now...GC is for a future job offer. EAD has nothing to do with it. Has it been 180 days since you filed your I-485? If so, your I-140 is safe since your employer loses "control" over it. Because your I-140 is not approved, using AC21 to port is quite risky but this may be your only path.
One last thing, I hope things work out and your employer re-hires you BUT you really have to assume that they won't and plan for you worse. Remember no one cares about your GC more than you...

It is too scary.. Plz note that the surname change is after mariz.. As per our convention, after mariz, wife's surname changes to that of husbands.. We have the mariz certificate with us.
Is this still that major problem, as earlier explained by you?
you are in serious trouble beyond your knowledge..consult a good attorney to correct it..

Im trying frantically to post this as a new thread but in vain . I would be ogliged if any1 of u can guide me through the process . Also not wasting further time i would like some info which is purely based on my discretion , but suggestion is well appreciated from u end .I would like to know wat r the things to be followed in h1 . Currently im facing issue with my h1 ie , my h1 was approved from this year lottery and it had a query which i have sent a letter to ins through my consultant , in aug but i have not recd any update so far . Im all confused as to what is my status coz at time im told that im on student visa and at time on h1 . Also if i find a job i will be paid only wen its valid . currently i stand on a crossroad of confusion , agony , pain and frustation . pls some 1 guide me thrgh this and if reqd i would apprecciate if u can also mail me . We had a discussion with our company lawyers about this. We wanted to know if it was possible to file for EB2 after a promotion. They told us the following and said we cannot change (dont know if its bs, you talk to your lawyer.)
a) EB is based on your previous job not the current one. So even when i have worked in my current company for 8 years, the current experience is not counted.
b) The new job/position should have activities more than 50% different to your previous position ( even tho i was eligible for EB2 then, i was suggested EB3, still suffering for that blunder). Unfortunately Software engineer is a position where the job activities include everybody uncle and more.
i think its a different story if you change your job, if you like your job and want to stay then there is little you can do.

I had 3.5 years of experience + MBA from India when I joined the current Job in 2001.
I applied for my GC in 2003 and the lawyer said since my MBA was not relevant for the current job (software engineer) and since my experience before the current job was less than 5 years, I should apply EB-3.
Currently, I have 11 years of experience (out of which 7.5 is with the current employer from whom I have applied for GC) and I have moved to Business Development that uses my MBA quals.
Can I change to EB-2? What do I need to do? What are the risks?
Any/all pointers will be appreciated
