you have to apply for extension hope you got the passport renewed.
Visa stamp is for entry, I-94 determines the status and length of stay. Even if the stamp is valid if I-94 is expiring you will be out of status.
If you have filed for I-485 then your status will become AOS.

The question is incorrect.
It should be, "How many of you have children that are non-US citizens?"
The reason is obvious. One less immigration visa if the kid is a citizen.

If I were you, I would consider getting a second opinion from a renowned lawyer.
Would request you to elaborate a bit.
Note that I am not using either my EAD or my AP. All I am using is H1-B and my Canadian Passport to enter and leave US. Most people on the Canadian US border to that.
Also, I commute to US everyday to work, which is less than an interval of 12 hours.

We all know how permanent jobs are here :) It's just the way the immigration law has interpreted it.
His point was more in support to legal-Skilled immigrants that create value for US of A ;)

I applied for H1B extension in october 2006 as my H1B was about to expire in December. After five months of applying, got an RFE in Febraury 2007 . My employer replied to the query in Mid March 2007. My employer was reluctant to do a premium processing when he replied the query, saying that he doesnt want to take any risk. CSC transfered my case to Seattle, WA field office ( the field office is no where near my employers physical location, not even close to where I live) on April 4th. I guessed that its because of new H1 petitions filed in April. Its been more than 3 months and no action taken on my petition. We tried to convert into premium processing, but the field office rejected it saying they dont accept premium processing in their jurisdiction. So nothing else to do but to wait wait wait. Total time passed since my initial petition in OCtober ( 9 months).
My license has expired in March and the DMV do not renew my license with out a new I-94. Really its been a hell with out DL and still depending on others for necessary needs.
I am tired of telling the story to every one. Why not one more time here. I want to find out what other steps I can take to expedite the H1 Petition. Is there any way around to get the license renewed. Please share your experiences and suggestions.

This is really pissing me off, without a driving license for the last 4 months, passport expiring soon, Wife's H1 petetion Query ( as her H4 renewal is in hold due to my H1B RFE). Guys please post some ideas on how to deal with this situation. I even opened a service request about my case. But no progress. what should be my next course of action to move the case.

Thanks brb2 for picking up on my concern.I was afraid,not a single person would reply.This problem is going to be as bad as the BEC one if nothing gets done about it.Its so unfair and there are soooooooooo many people stuck at that stage with no hope of even knowing their status,until its actually approved or denied.Cant even imagine how frustrating that is going to be.Yet somehow not many seem worried about it.Even though i am not at that stage yet,its painful to see my friends go through it.They have resigned themselves to wait endlessly.If we can fight against the unfairness of the july flip flop,we can surely do something about this.I am sure core group has this in mind but it'll help if all members show the same anxiety!!Maybe we can bring this up along with the SKILL bill.Maybe the FBI needs more funds or manpower,watever it is,let them ask for it and get it,instead of stuffing us all into this bottomless pit!!

You mean to say CIR will be introduced to the immigration or judiciary senate committee or introduce directly to the senate. If it is introduced directly to the senate floor that will save a lot of time, on the flip side it will become difficult to add or change provisions if it is directly introduced to the senate bypassing the senate judiciary and immigration committee
Bills almost never go to the floor directly. Especially something as huge as CIR. It will go thru committee again and it will go thru normal rounds of debate and amendments between the 18 people in Judiciary committee.
Its very unusual for a bill to hit the floor directly without going thru the committee that has jurisdiction over it. If it happens all the time, then the committees would be meaningless. The whole point of having a committee is to be able to either kill the entire bill, or a congressional appointment before such a bill / confirmation is debated by all 100 senators. Same thing in the House.
If it was possible to bypass committees, then people would have floored the SKIL or other bills directly on the floor of the house, therby bypassing Jim Sensenbrenner and his Judiciary committee last year.
