Question is what happens if I decide to withdraw the H1b App

If my employer won't give the wage reports etc. today.. he's definitely not going to give me that even in future then..

Agree with you 100%. And this does not require a law change and is relatively easy. Not very easy, but easier than getting a new law passed.
I saw a comment on a lawyer's website that recapture of unused visas can only be done through legislation and not through administrative fix..
And, the real issue we should try to address here is USCIS inefficiency.
There are a lot of " worldwide" category folks who have been current for over a year (and a few months after the 180 day memo) but are yet to get their GC.... So unless we get USCIS to move fast on the applications that are current, all our visa recapture efforts help DOS to move cut off dates further ahead.. but if past history is any indication, more of these visa #s will be assigned to Consular processing cases rather than AOS cases in USA..
So.. I think while lobbying for Visa Recapture is the right move, we should also lobby to highlight USCIS inefficiency in adjudicating cases that are current..

I have been feeling sad that I have not been able to make it to the rally and after hearing about the energy, the camaraderie and the excitement you all shared I know for sure I missed out on a once in a life time oppurtunity, there will always be that sadness in me, the only comfort I have is that I tried to contribute in ways other than attending the rally.
But I am very glad that this turned out be such a resounding success.

Yesterday evening even my case got transferred to local USCIS office . I have LUD on my I140 for today.My daughter's case is still with old LUD.

I totally agree.
My PERM application was rejected several times due to my ex-employer Attorney's negligence, and my priority date got pushed. Finally, I ended up hiring my own attorney, and hence I was able to file AOS back in July 2007.

Try to submit as many proofs as you can, such as pay stubs, tax papers, appraisals & etc. As for the experience letter, your attorney should write a letter to USCIS explaining the situation, with all the above mentioned documents attached.
Oftentimes, we know better than what some attorneys do. They are not always right.
Seek a second opinion if necessary.
To add to that, keep following up with your lawyer. Dont assume that lawyers know everything. My lawyer destroyed my case and made me loose my 2001 labor. I have now refiled and have a 2004, a loss of 3 years, but in reality, I could have had my green card nearly 8 years ago if it had not been for the mess up. There was nothing that I could do as the company was running the show. All i could get them to do was to refile again.
In addition to the letters from co-workers, send as many paystubs that you can get, W2 forms and tax returns (or the indian version), bank statements, etc. Also include a letter along with proof that you requested a letter from your old employer.

Now coming back to my question. My labor is approved and I-140 is pending.
I have declared that my employer is applying for my GC.
Should i carry documents proving that my I-140 is pending and that labor is approved?
My 6th year H1-B will be expiring in Aug 31 2007 and i have valid I-797 approved upto that date. I know i can get 3 years extension anytime with approved I-140 or atleast 1 year H1-B extension.
Will that be a problem at all? I am asking this because, the numbe rof months for which stamping will be valid will be just few months.

We are in exact same scenario, but was thinking that H4 holder has to enter using AP to continue to use EAD after "vacation" . So is it like, Use H4 for travel and EAD to work, instead of , Use AP for travel and EAD to work? This will be of great help to many people who are scared to use AP or not want to face the extra half hour at immigration counters.

Ask your employer, what this agreement is supposed to mean for you? Are you working on hourly rate? If so I can see why employer wants this agreement. He wants to pass all the risks to you. If I were you, I would not sign anything like this.
Once in a history a mid vendor asked me to sign this type of agreement. I took it to my employer and my employer told him something,"I dont know what he told him" and the vendor came back to me and said, no need to sign it. MY employer said he had a frank conversation and that we are not his slaves.
So dont hesitate to bring up that with your employer, if push comes to shove.

I have EAD for couple of years & when I moved to Ohio, I was issued 4 years DL. They did look at I-94 (I travelled on AP having one year validaty on I-94), also they DID NOT looked at my EAD expiry date..They asked very simple question - Do you have your SSN? Thats it..!
C'mon...Guys, come to Ohio..you will get DL for 4 years..
I am not sure if the laws have changed but I worked in Cincinatti, OH before sept 11 and they renewed my driver license until the H1b expiration date.
Later in FL until the I 94 date
