    gc_chahiye, Thanks for your response. So, can I be on H1 with my current employer, A, and on EAD with my new employer, B, simultaneously?

    Also, employer B might be able to start me on H1-B (my preference--just in case)--though as you said, B will have petition my new H1 for concurrent filing. My other option, of course, is to wait until Feb '08--though I'll miss out on a month's salary from B (not a biggie in order to not have any potential issues).

    Why dont you just work for your new employer in december on voluntary basis and take the salary in Jan as a signon bonus?. This way you will have a clean record of 6 months on H1.

    Thanks for your post. It's good to hear the perspective of a core member of IV like yourself. I understand your point of view but respectfully disagree with your definition of the greatest good. The greatest good will not be achieved by just passing the labor cert. stage. The greatest good is achieved once we have the GC card. Your effort on retrogression to benefit 250k & 200k is plausible. But you help them to pass one bridge, to just get stuck on the next. If there are 25k people stuck in name check at this time, imagine what will happen when the estimated 200k-250k reach that stage.
    If the 25k spent in average 3 years in the name check, what will be the wait time for that massive population that are headed that way after retrog & labor cert? The EB process is a big picture and the greatest number will not get the greatest good until all these obstacle are resolved all the way to the end.

    sroym, i think the point stucklabor was trying to make is, that currently most of the people are stuck in retrogression and labour which makes things far more unbearable than actually having an EAD/AP and such benefits. There is a whole thread on this discussion where members of all nationalities have complained about IV not taking the FBI name check issue seriously. I think the moot point that IV core members are focussing on is, the fact that retrogression is making life unbearable for just about everyone. Plus given the following facts:
    1) A Serious Majority of the IV members are affected more by retrogression+labor as compared to FBI name checks. and
    2) IV core members have full time jobs and spouses and are working pro-bono for the good of everyone and money collected is also coming in slowly and thorugh the IV members themselves.

    These 2 facts mean that both time and money is at a premium and they have to spend it solving the problem they originally started to solve. Believe me, some of the core members themselves are stuck with the FBI name check issue for the past 2 years or so.

    Given all these facts, you have to understand where IV and it's mission/policy stands. To my understanding the policy is "One step at a time".

    We have to wait till April to walk or run in Michigan. Right now, the Artic wave is brutal with subzero temperatures.

    I support this initiative. IV members need to volunteer for social service and other community events. That's our way of contributing back to communities we live in and also good press for IV.

    accommodation during stay.

    SIERRA LEONE
    Visa required. However, visa on arrival is also possible under

    - no diplomatic representation of Sierra Leone at point of
    origin; AND
    - sponsor or contact person in Sierra Leone should arrange
    Landing Permit with the Principal Immigration Officer.
    Details of such Landing Permit should be given to the

    I already fought this for three good years! I don't know how they allow L1 to enjoy in-state tuituion and not H1B. I provided liks to USCIS to ASU to prove that L1 and H1 are similar non-immigrant visa. I gave up after they could not provide any reasonable response.

    Did you threaten them with a lawsuit. You would be surprised at what a threat like that can do.

    My F1 visa was rejected for no good reason long back, before i even came on H1B. So its kind of scary every time I have to go for visa stamping. Its very random. Guess its just the fear inside me.


    So I guess its all about the risk, if or not I want to get my H1B visa stamped or just wait for the freaking AP.

    I was in the same boat as you and came here subsequently on H1. I do not think your F1 reject has any bearing on your H1 stamping both are different. If your stay in the US has been lawful, no gaps, out of status etc then you should be good be in good shape. You know the drill on the documents to carry etc if needed to get the stamping out of country.

    Hello all,
    Does any body know why DOS isn't applying the spill over on quarterly basis... Law clearly stipulates that unused visa's should go to retrogressed countries..

    Excerpt from may visa bulletin:

    llocation of “otherwise unused” numbers in accordance with Immigration and Nationality Act (INA) Section 202(a)(5)

    INA Section 202(a)(5) provides that if total demand in a calendar quarter will be insufficient to use all available numbers in an Employment preference, then the unused numbers may be made available without regard to the annual per-country limits.

    I asked this same Q on the last conf call with Susan Henner and she said that they will not do it. As her H1 application will have an indication that her H4 is pending, they will mostly issue an RFE to prove her H4 status thru Sep 30th or wait for the H4 to be approved before aproving H1. You should be approved soon. last month processing times said they were doing dec 21st right?

    So you mean I should not even think of invoking AC21 EVEN after 180 days ?

    go ahead and invoke AC-21, you are not necessarily going to run into the problems that poster faced (in fact based on anecdotes on Forums the AC-21 related denials by USCIS have gone down a lot since 2005, probably because of the yates memo that came out then calrifying all this). Try to stay on H1 as long as possible though (you dont HAVE to use EAD to invoke AC-21 and change jobs).

    At the end of the day a lot depends on your luck. Some people get unlucky and end up with all this nonsense, some people end up getting caught in namecheck... they are both thankfully a small percentage of the cases, so dont let your career choices be decided by what USCIS might do. Take precautions where possible (staying on H1 etc) but do what you think is right for your career and family. The whole point of this AC-21 clause was to provide flexibility to the employee, make use of it.

    P.S: I am also planning to invoke AC-21 to switch jobs.

    As per law, one must always carry the original GC with them, like DL. You can see this instruction in 485 approval notice/welcome letter. I am doing it.
