This is a question and request for all my friends here who read this thread, please take a moment and think what we need and what all can do.

Mahatma Gandhi, bless his soul, had the balls to stand up and fight back. On the other hand, majority of our community live in the fear of their own shadows. We should stop comparing our sorry selves to that great man when we lack an atom of the courage he had.
We don't want to goto DC Rally in March as it's too cold. Summer is too hot and in the spring we have family vacations planned. We deserve the punishment we are receiving for our inaction.
Can we do something about this.
Isn't it something similar that happened when Gandhiji was thrown out of a train is South Africa. Gandhi was discriminated based on his color. We are being discriminated on immigration status for our right to work.

Hi Everybody, I have a question to the people who already invoked AC21? Do we need the I-485 receipt to invoke AC21 or can we use I-797C(Biometrics notice) as proof of AOS pending? My employer and employer's attorney did not agree to give me the I-485 receipt. I filed FOIA but did not get anything yet. I could file EAD and AP online and send the biometrics notice as supporting doc, received EAD and AP is pending. Does anybody know if there is any other way to get the I-485 receipt or is it really needed for AC21?

The Swiss do not break down the source of the Indian money and it could all be EU accounts of Indian companies that have operations in Europe. We just do not know. As Switzerland has the lowest tax in Europe, a lot of companies with operations in Europe have accounts there.
If India had sensible policies it could generate Trillions of $s and this 1.4T would not matter.
I am trying to start a Pvt Ltd in India and it takes about 40 days and $3000 to get started. In MA, it takes a few hours and less money despite the much higher lawyer fees here. No wonder the country is poor. It is not the corrupt people but the honest (but incompetent) people who do more damage by slowing the pace of business.
The path to hell is paved with good intentions.

Just curious - Have you heard of a case being rejected just because the salary was higher than the original LC ?? (Assuming job title/description are same or similar). I think it will be almost impossible for them to reject just because is higher!! Govt. cannot dictate the upper limit of salaries (in private sector).

For H1B: use your vacation time to be associated with your current employer for as long as possible, try pay without leave if possible. No hard and fast rule how much gap is allowed. In principle, there can be no gap but lawyers claim 10days, 2weeks is okay. USCIS asks for recent pay stubs to check for gaps.
You are in much better shape with >180 days in AOS. Can work in EAD if needed.

All,
My employer revoked the i140 of a person after 180 days. He did not reveal this information to me and used labor substitution for me.
The other person used AC21 and got his 485 approved. INS has denied my I140 since a 485 has already been approved and there can be only one GC on one labor. INS says that once the 485 is approved that job ceases to exist.
My company is saying that they have done this in the past and got approvals. They are saying that they applied the I140 substitution long before the 485 approval of the other person.
Now they are saying that they will appeal that the other guy never had the intention of working for the comapany.
Is there any chance for the I140 approval and using the existing labor ? If not will the INS help me keep the Priority Date.
Does anyone have knowledge of such cases (or) know the results of such appeals.

I would suggest, you explore other option and try a join a new employer to process GC rather than looking for options that are uncertain. Although, I feel sorry for your case, it does not sound right to jump lines, while so many people are waiting in line for GC for many many years. There are certain genuine cases in LC Substitution case, but these are very few in numbers, and also it just can't be right when someone just gets ahead of you, while you are waiting for years. It is really good, that LC Substitution is eliminated, so that people like you do no loose the precious time depending on these employers like this and also people who are waiting for years get their chance first. Appealing, etc can be done, but a positive outcome is very very slim in this case, if the original person had worked for this employer for 180 days or more and invoked AC21, then AC21 protects the original beneficiary. If original beneficiary has not worked for this employer at all, then there might be a small chance, but still it is very complicated. As posted here, talk to an attorney other than your employers attorney or yours and get a second opinion and decide accordingly.

when my lawyer applied my 2nd I-140, he clearly asked PD to be ported so I got the PD ported but since, I already applied I-485 a few days ago, so I could not include my new I-140 with that. Now, my attorney is going to request USCIS, to update my I-485 file with the new I-140.
I am not sure if this case has anything to do with PD needs to be current.
