this is mainly due to July VISA Bulletin fiasco and thousands were allowed to apply for their I-485, due to USCIS/DOL July 2007 VB.
one moe reason lots of Citizenship petitions were also filed in July 2007 to take advantage of old fees structure.
All countries of chargeability and employment categories were made current, since Dol was frustrated with USCIS's slow processing rate for I-485 and had Dol not made the VB current USCIS would have wasted few thousand VISA numbers as usual.
Silverlining is that we were all given freedom of using EAD and get new jobs or promotions using the AC-21 provisions...but the long term side effect is the slow moment we are seeing for the processing dates.
NSC is slow since lots of high tech H1-B employers are from CA and WA states and they applied truck load of I-485 versus the folks in Texas Service centre.
We are all hoping that once USCIS is out of this naturalization processing pressure before the elections, they would start processing the July-aug 2007 I-485 petitions.

I was just thinking if it would help to gain more publicity if this site goes by a different name. On several instances while calling lawmakers or other people, the moment I mention immigrationvoice.org they think it is related to Illegal immigration / CIR etc. I need to stress that it is about legal immigration.

1. Does anybody know of any good immigration cunsulting company for Canadian PR processing ?
2. How much would be the total cost to get it done throught the consulting services ?
3. Are there any hidden costs which these companies tell you at the end and try to rip you ?

You do not need a lawyer. You can do it yourself. This is what I have gathered from various forums. It is much easy than the US process.
BTW I have not applied yet!! I sincerely hope we all 7500+ IV members can get a bill passed soon enough.

Hi Guys,
Could any of you let me know the impact of multiple job changes on AC21, with approved I-140 and after 180 days of I-485 receipt, and with similar job code and description. I changed first on January 25 and now it will be 3 months after the first change. I have following concerns and seek your opinions soon for the decision.
1- Will this quick change be a concern even though I will have same/similar job code as per O*NET and job description and there is no law against it?
2- Should I have, in addition to H1B transfer, another Labor certification started with new employer as a back up?

Since you have a PhD and reserach in Aircraft Braking Systems, which can be argued as aircraft safety and in national interest, you may qualify for NIW. It all depends upon you how well you argue your case as NIW and how good are your recommendations and support documentations. You need to get your papers published in reputed Journals and also get onboard of journal publication evaluations.
You also need a good lawyer (however you will end up doing 90% of work because of your unique field of research). However I would not recommend Murthy or Rajiv, because NIW is not their speciality. You need to go to a lawyers who have NIW and EB1 as speciality.
EB1 is not a good category for you, as of now, but it may change depending on your career progress.

Please don't travel thru countries that impose this ridiculous transit Visa requirement on individuals, especially from India. Ask them to justify the charges, and you would get no response from them.
So, even if takes to spend $200 - 300 more, AVOID these crook countries that charge Transit Visa. People we must send the message across. In this century, I think its Indians that are traveling the most on these trans-atlantic-asia route, and collectively avoiding these 'snob' countries would send a very good signal.
If you are buying the transit visa, your dignity is at stake. Its like saying buying insurance for a person who is poor. They dont charge for countries that are more developed. so, AVOID AVOID these countries.
I am traveling to India soon, and I am going thru Brussels not because I got a cheap ticket, but because there is no transit visa required there.

Chandu is one of the active folks/volunteers who is helping us more that we are helping ourselves... His push and constant nagging are coming as +ve reminder who couldn't send letter due to hectic schedule or are still Procrastinating ( there is a huge chunk of people like this ) . There is no problem in TX. My H1B is expiring in Dec 2006. I got New Drivers License upto Apr 2013.
But, for H4, they wanted to see visa stamped. There is no relation between H1 / H4 / I94 validity dates to issue.

If the person gets the visa stamped on the passport at the US consulate abroad, I do not see any problems re-entering.
AP is only optional. You can always get a valid US visa stamp based on the approved petition and use the H-1 visa stamp to re-enter.

I think for you to be able to use AP to enter it should be approved prior to your exit out of the country. You might want to consult an attorney or USCIS on this. If the IO at POE stops them there is nothing you can do. So be very careful on what you want to do here.

1. Try to say you do NOT intend to provide supporting documents for a I-765 for a pending I-485 application (If you have provided I-485 case number and correct Alien number already).
2. Immediately after the e-filing send the supporting documents (well arranged and tabbed in order of significance) with a copy of the e-file receipt. Unless you provide this, the case would NOT progress. I even talked to an IO who stated that I should not send any documents till requested, but its my experience that you should send the documents immediately after the e-filing.
Lesson for all e-filers:
