There is a section in 485 application to list your spouse and dependents. Talk to a good lawyer to see if you can still add her. Or you can live in india until you figure out a way to bring her here on student visa or something.

As per AC21 rule, it is from Receipt. However, let's put some practicality into the matter. Some IO's interpret the rule wrongly and used Notice Date instead. So what will happen? Your GC denied for wrong reasons and you file for MTR because it was USCIS mistake. If you're willing to take the chance, then go. If not, better use Notice Date for practicality purposes and to avoid all the hassle of MTR, etc.

I'm gonna write too. But can someone post a draft. Instead of a letter saying please give me greencard I do not have one.... we should have a letter saying please do admin fixes and these are the fixes.
If they send it to USCIS then USCIS will not send you a reply saying your PD is not current. So we cannot do Admin fixes.

Had applied on July 19th , receipt date of July 20th.
I never received any receipt notice and today I received transfer notice

Notice Date Sep 17th 2007.
Does it mean I lost the original receipt date of July 20th which should have been ideally my receipt date.
I have a similar issue. Although my app reached on July 2, 2007, the "receipt date" on my notice shows "Aug 3, 2007" and the notice date shows "Sep 12, 2007". So, in my case too, they've not honored my original receipt date. Did you manage to get your's corrected on the receipt notice, or not worth the time/effort?
Appreciate your inputs.

Folks - one must also realize that talking to administration and getting things dione costs a lot of money through advocacy and IV needs a lot of money.
So please be generous enough to contribute to IV - we need a lot of funds in these times when we really needs help

My understanding is that I-140 has to be approved to interfile. That's how it used to be anyway (you could not file I-485 concurrently). Anyway, interfile is not automatic so why the lawyer cannot file a second I-140 is beyond my understanding. Interfile exists so that you do not have to refile I-485, but it's up to you whether you want to do it or not.

Did you fill the actual I-485 forms or just the questionnaire that employers usually send? in case you've filled actual forms that they will send, did you check the box on the right bottom where it asks if you'll be represented by an attorney...
In case of a questionnaire, you might get those forms filled by them for your signatures.

My employer had legal dept and lawer filed G28 form for me when applied for I-485. Do we really need to hire a lawyer to represent us? I am planning to move to client under similar job description this month end and would like to see if I have to file AC21 and change the lawer representation.
I appreciate any response.
You do not need a lawyer. Just make sure CIS has your correct mailing address and keep watching your cases regularly for RFEs.
In the event of an RFE, you can respond on your own most of the times. If you think it requires a complex response or if you are not confident, you can hire a lawyer at that point to respond to that RFE.
I would even say handling your case on your own is safer as I know some cases where the lawyer goofed up by not responding to RFEs. The applicant was not even watching his case status as he had left everything to the attorney and he had no idea about the RFE.
It is also not necessary to inform CIS about your job change unless there is a possibility that your previous employer may revoke your 140.

It's important to have the goal clear. Trouble with "Truth based Stories" is that they deviate very soon from the truth & start focussing more on the aspect of entertainment (American Gangster as a recent example). I don't like the idea of diluting the subject to make it more entertaining.
Entertainment means different things to different people. There has to be a target audience in mind before making a movie. The larger the target audience you focus on, the lower the common denominator becomes. This is the reason Lou Dobbs has a bigger audience than Bill Maher.
I think the idea of documentary is more true to our purpose even if it may reach fewer people.

Contacting the indian Ambassador..that is something new..how can we contact him or how do we drag his attention....
also those 140 processing times do not make any sense..a friend of mine got his 140 approved today..which was filed in Sep 07 under EB2 ..
Let Indian ambassador fix the Indian consulates in US first. Service and courtesy at Indian consulates in US is so pathetic. USCIS is far better compared to Indian consulates.
