The Department of State announced that the Indian EB2 category is expected to advance one week in the May Visa Bulletin. The demand for EB1visa numbers has decreased by 50 percent this fiscal year. Last year from October 2009 to February 2010, 22,000 EB1 numbers were used. During the same period this year, only 10,000 to 11,000 have been used. EB1 will be current worldwide all fiscal year. This will free up an estimated 12,000 visa numbers to fall down from EB1 to EB2 this year

Point to be noted is that this case was not dismissed on merit, but that plaintiff's have not been able to prove significant damages resulting from the rule. A general 'dissatisfaction' with the rule ( for e.g. my wait times will increase if porting continues) doesnot translate into significant damages ( such as I'm losing the job). The merit of the case was never discussed!.
It would be interesting to see how many of the 'Yes' are going to remain 'Yes' when it comes to having their names on a lawsuit filed against USCIS (the whole list will be going to USCIS). It will be interesting to see how many of you stridently remaining anonymous on a (relatively) harmless public forum such as IV are going to come out in public to fight the USCIS. Good luck guys.

We have plans of visiting Canada in November. My card had a data entry error because of which I have to apply for a replacement card. It can take 3 months for that.
As I have no other proof of permanent residency (as I have to return the card with error), alternative is to get the I-551 stamp on the passport that is valid for 1 year. It works as a short term replacement of the acutal card.
What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

I always thought, the system was fair, it was only the overwhelming numbers of immigrants from certain countries that made it look unfair....but the closer I get to the stage where DOS decisions start impacting me, the more I realize that the system is not fair at all. The game of visa numbers and allocations is driven by white house politics alone...DOS being the spokesperson for the politics. Essentially the white house is directly throttling immigration through the DOS...on its own whims and fancy.
So, what made you import yourself here? You could have stayed back in your own country..by the way, coming on a H4 was a choice..it wasn't forced upon you...didn't you know before coming here that you would have to stay home on a H4? H4->F1, H4->H1...all these options are always open to you..
Do you respect others feelings here...

The Gandhi Protest
Several readers commented on a posting earlier this week about 200 skilled immigrants from India who tried a Gandhi-like tactic and sent flowers to the government's immigration director for help in moving their green card applications along. The U.S. Citizenship and Immigration Services forwarded the flowers to soldiers recovering at Walter Reed Army Medical Hospital, saying it understood the intent of gesture.

As a highly skilled H1B worker in the US, let me the set the record straight on a few common misconceptions:
- Many of us come from upper middle class families and didnt come to the US 'seeking quality of life'. We already had it.
- Many of us have graduated with distinction or higher from TOP US universities where we competed with 'local' talent and aced the programs, with NO SPECIAL FAVORS
- All of us are PASSIONATE about the PROMISE of the GREAT AMERICAN DREAM. We work hard because we want to, not because we need to. (Hint: We are ambitious and can hence go to any country in the world!)
- All of us are an INTEGRAL part of this society, paying 28%-33% of our $100K+ jobs as TAXES that go back to the US economy
- All of us continue the great tradition of the US being a melting pot
Go back to the age of the Gold Rush. We are the new Gold Rush. We are the new Lewis and Clarke. We are adventurers, learners, experiments, believers, doers.
We are not lowly paid 'tech slaves'. Get the media misconception out of your heads.
We are PROUD to be part of the Great American Fabric. We strengthen this country with our diversity. We will continue to contribute selflessly to make this a greater, stronger nation.
And while we are it, we wont forget that our own future generations might take it more lightly and risk messing up their careers. Anyone that has 'life handed to them in a platter' ends up messing it.
So, please take your heads out of the sand, quit being protectionist and complaining the someone moved your cheese. Look at how you can move and be flexible, nimble and adaptive.

Lack of information is driving everyone in a chaos and people make mass calls frequently to get information. USCIS should be providing all basic information on cases on case status area of the website. This would reduce number of calls to USCIS and reduce such posts where each conversation with an IO generates some information and misinformation on forums. This feeds to rumors and incorrect information circulated on forums. While such information helps generate lot of threads, page views and ad revenue for other websites, As an organization we should be cautioning people about this.
On the donor forum we have posted some tips what you can do get your greencard. There is no need to make calls everyday trying to get status. If your application is outside processing time, you can simply open a service request. There are other options like Ombudsman and local Congressman's office. We have also posted to our members that if if you have tried all options everywhere and you are in a desperate situation, Immigration voice will help its continued donor members.
In my opinion posts such as "storage area, exam area, and where your file is, pre-approved" only drive curiosity and mass calls that will not help processing of your case. We as an educated and mature community should not fall for such information on the forums.

In case you havent seen my posts befre, I have been stuck due to PIMS for 56 days !

I had my interview for an H1-B at N. Delhi consulate on December the 5th, 2007. The consulate officer told me it needs administrative processing and gave me a pink slip. I was also told that it may take anywhere from few days to 7-8 weeks. Today is February the 8th, 2008, and am still waiting on my visa. So if its any consolation to you stuck_here, I'm stuck here for almost 65 days now. Given that I have a PhD in Chemical Engineering, I might have fallen under the Technology Alert List, but, still, the wait time seems ridiculous. Any ideas from anyone about if there is anything I can do on my part to expedite the matters? Thanks.

If waiting time for GC is reduced less than 5 years then this may not be needed except for persons those who are filed GC before 2004. The environment is so tough that they trashed non controversial recapture bill on 2008. So it has to be decided based on how the CIR will shape up this year.
Do not think this to discourage or anything like that...

You are on the right track....Again no need to thank me....the help in the forum is mutual...I had gained strength from it and I'll reciprocate in every possible way...I am not one to vanish from the forum once I am done and see you guys waiting......well experience with USCIS is like a psychological trauma...it stays long and being a scorpio I can't forget things at all especially injustices....So I'll be there along the way for all you guys....and help you in whatever way I can......
That being said every case is different and gloom and doom scenario should not take over your spirits....I am a cynic by birth and see the glass always half empty but once thing that is different for me is that I never give up......and neither should any of you guys however bad the situation is....be a cynic be a pessimist be a paranoid if you can't help but BE PERSISTENT and UNRELENTING...

You are on the right track....Again no need to thank me....the help in the forum is mutual...I had gained strength from it and I'll reciprocate in every possible way...I am not one to vanish from the forum once I am done and see you guys waiting......well experience with USCIS is like a psychological trauma...it stays long and being a scorpio I can't forget things at all especially injustices....So I'll be there along the way for all you guys....and help you in whatever way I can......
That being said every case is different and gloom and doom scenario should not take over your spirits....I am a cynic by birth and see the glass always half empty but once thing that is different for me is that I never give up......and neither should any of you guys however bad the situation is....be a cynic be a pessimist be a paranoid if you can't help but BE PERSISTENT and UNRELENTING...

I have taken an infopass tomorrow to get the I-551 stamp on my passport. Once that is done I will be mailing out the form I-90 for replacement.
What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

DOS has to be utterly dumb, insane and ludacris....
what makes you think they cant blame USCIS statistics for this? USCIS gave us wrong stats, we made it current, then they said that no, they have enough visa numbers.
If its written into law that DOS can only issue VB once per month, and cannot update it during the month, they cannot do a damn thing.
its not written into law that they cant update it mid-month. They are allowed by law to update it whenever they want.

No one can travel on EAD. EAD is for employment authorization. AP is for travel. You cant mix and match the purpose of them.
If you dont need to travel or if you have a valid H1 stamp for travel, dont file for AP. If you want to travel and if your stamp has expired and dont want to apply for new stamp, then file for AP.
If you want to work for your employer and continue there and if you are sure of your job security, then you dont need EAD, and dont apply for EAD. However its a good idea since EAD is a great option of you are suddenly fired or laid off. EAD makes it easy to search for jobs coz the employer doesnt have to file your H1 and you can join them immediately without any hassles.

So, as per your post, I can apply just for EAD, right? That is if I want to switch jobs after 180 days using AC21 and if I start using my EAD, can I go out and come back with my valid H1B stamping? Or do I need to have the AP since I have started using my EAD??
Similarly, can my wife use her H4B even after she starts using the EAD instead of AP when she travels??
Any help is greatly appreciated.

H1 renewal and change of employer
H1 approved in March 2007
Service center: WAC
Visa appointment on Feb 11 at mumbai
Documents submitted to VFS on Jan 28
On feb 11 I went to consulate and it was a long wait.. overall it took 3 hours to finish everything. When I went inside they handed over my application to me and I noticed that "Not in" was written on my DS156 form on top right corner box. here is the communication with IO
IO: so you are working for xyz company.
me: yes
IO: what are you doing for them
me: explained my role and skills
IO: are you working inhouse or at client place
me: gave client name and details
IO: till which date you are going to work for this client
me: gave details
IO: everything looks fine in your case but similar to what I have told everyone else due to the new system we need to verify your data and it will take about a week for that. (and then he wrote PIMS on my form)
me: I have a return ticket on so and so date...... can I expect before that.
IO: your case is pending only for the online verification unlike other administrative processing so it should take about a week so you should be fine.
he then gave passport back with some envelop and also one yellow paper by selecting following option in that paper
"when administrative processing is completed on your case, you will be contacted and requested to submit your passport, this letter and the accompanying envelope to the nearest VFS office."
though he selected this option, he specifically wrote PIMS on my form.
Note that PIMS problem was there for lot of cases on that day as he explicitly told me that he had to do this for lot of cases.

What stops USCIS is the per country cap. They can only issue so many visas to EB-3 I.
