There was a thread related to similar issues which I could not find. Apologies for opening a new one.
Doesn't the above constitute discrimination and illegal ? What recourse do we have when we are disqualified because of EAD ?
My neighbour just got a job at Capital One last week using her EAD . So I am not sure which policy this HR person is talking about. Capital One definately takes people on EAD and my neighbour is proof of it !!!

A basic question - Are the months that the numbers are slotted into for the Priority Dates? or are they the recept date or something else....?
If PD, then how come there are numbers for 2008 and 2009? The PD has never been current since July 2007....

Let me add my 2cents here.
This came up when I was discussing this topic with my lawyer friend -
Person can still file for GC when he/she is at school in eb3 and after finishing school, he/she can file another one for EB2 and can port the date to earlier PD, just like eb3 person who started work instead of going to school. Remember, GC is for the future job and person can not claim that he/she needs to be employed in order for GC to be filed.
Law does provide equal opportunity to both for PD recapture (aka PD porting).
Disclaimer: I am green card holder for 6 years and personally this issue does not affect me.

Can anybody tell me what do i need to put on I-765 , Q11, as i am not able to rely on my company's attorney.
11.Have you ever applied for employment authorization from USCIS?

it says that you need to put yes and have to attach all the previous 797's.
But my attorney says that you need to put No. Only those who applied for EAD earlier have to put yes (Which i feel not correct).

If you have never applied for an EAD card before then the answer is NO. If you have had an EAD before then the answer is YES. Pretty straightforward really. Your work visa is not an employment authorization in this context.

I don't think the madness will end anysoon, as Lou "Liar" Dobbs show is providing execellent TRP to CNN. And advertisers will put their money in shows that provide maximum coverage. Says Stahl, "60 Minutes checked that and found a report issued by the U.S. Department of Health and Human Services, saying that 7,000 is the number of leprosy cases over the last 30 years, not the past three. The report also says that nobody knows how many of those cases involve illegal immigrants." (Emphasis ours). This exchange then ensues:
"We went to try and check that number, 7,000. We can't...," Stahl says.
"Well, I can tell you this. If we reported it, it's a fact," Dobbs replies.
"You can't tell me that. You did report it," Stahl says.

One idea is to give GC to AOS applicants regardless of namecheck result, if all
other security checks are OK and let the namecheck run in background . If the namecheck turns out critical , cancel the GC & deport the applicant.
But USCIS and lawyers will loose big time , because of reduced demand for APs,EADs etc.
Lets add this in IV action Item.

Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?
My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

There are very much needed in this time of economic crisis. Applicants in EB3 and EB2 Employment based greencard category are severly backlogged.
The problem is mainly due to country based quotas and wastage of many greencards due to administrative delays over the years, as you know. This can easily be fixed with a simple administrative action and need not need to be done as part of the bigger comprehensive immigration bill. We too need a change.
Below are some statistics and details of the problem, just in case you missed a point.
1. High technology H1-B visas allowed into US = 85,000 H1B per year.
2. H1B quota limit per country = None, quota limits.
3. Greencard eligible candidates = All H1B holders
4. Total Employment Greencards = 145,000 per year.
5. Quota limits for greencards = 7% per country and each family member is counted as 1 visa.
6. H1 holders from India = 30,000 to 40,000 per year.
7. Greencards available for India by quota limits = 2000 – 3000 per year.
8. People waiting in Queues = 37,000 – 38,000 per year.
9. Estimated wait = 10- 15 years per life.
10. Estimated loss of productivity = unlimited.
11. Loss of health and health related issues due to these worries = incalculable.
Consequences:
1. EB3 Employment based category from India is severely backlogged,
2. Number of applicants in Queues waiting to buy house = 300,000
3. Number of applicants in Queues buying a house now = 0.
4. Money spent by applicants on rent per year = $6 billion
5. Number of applicants having Citizen children born in US = 80%
6. Number of applicants unable to start own companies(as they are tied to employer all the time due to greencard sponsorship)
= 30-40%
7. Applicants disappointed and leaving US = 10-15%
8. Applicants planning to come back after retirement who take with them US Citizens who will sponsor them = everybody who is leaving US right now with Citizen kids
9. Burden on social security and healthcare by applicants in point 7 = billions of dollars.
10. Severe pain for everyone wasting time on worries and uncertainity.
11. Many people thinking of returning back, very disappointed.
Solution
Please provide immediate relief. We are still holding our bags in hands even after 5-10 years of playing it by law after applying for greencards. Please respect liberty and freedom and let that happen to legal applicants.
1. Please remove country quotas for greencards immediately to make waiting less for legal employer based EB2/EB3 applicants from India in long queues ALREADY in US for years.
2. This needs No new jobs or Visas. It’s just a simple fix to help bring joy to some legal immigrants and give them freedom to contribute more.

We think this is the best time to do it as there are so many waiting in long queues for so long and are unable to buy houses though they are at rock bottom prices now, or change companies as some of us would also like to, and start new companies and jobs. There are very much needed in this time of economic crisis. Applicants in EB3 and EB2 Employment based greencard category are severly backlogged.
The problem is mainly due to country based quotas and wastage of many greencards due to administrative delays over the years, as you know. This can easily be fixed with a simple administrative action and need not need to be done as part of the bigger comprehensive immigration bill. We too need a change.
Below are some statistics and details of the problem, just in case you missed a point.
1. High technology H1-B visas allowed into US = 85,000 H1B per year.
2. H1B quota limit per country = None, quota limits.
3. Greencard eligible candidates = All H1B holders
4. Total Employment Greencards = 145,000 per year.
5. Quota limits for greencards = 7% per country and each family member is counted as 1 visa.
6. H1 holders from India = 30,000 to 40,000 per year.
7. Greencards available for India by quota limits = 2000 – 3000 per year.
8. People waiting in Queues = 37,000 – 38,000 per year.
9. Estimated wait = 10- 15 years per life.
10. Estimated loss of productivity = unlimited.
11. Loss of health and health related issues due to these worries = incalculable.
Consequences:
1. EB3 Employment based category from India is severely backlogged,
2. Number of applicants in Queues waiting to buy house = 300,000
3. Number of applicants in Queues buying a house now = 0.
4. Money spent by applicants on rent per year = $6 billion
5. Number of applicants having Citizen children born in US = 80%
6. Number of applicants unable to start own companies(as they are tied to employer all the time due to greencard sponsorship)
= 30-40%
7. Applicants disappointed and leaving US = 10-15%
8. Applicants planning to come back after retirement who take with them US Citizens who will sponsor them = everybody who is leaving US right now with Citizen kids
9. Burden on social security and healthcare by applicants in point 7 = billions of dollars.
10. Severe pain for everyone wasting time on worries and uncertainity.
11. Many people thinking of returning back, very disappointed.
Solution
Please provide immediate relief. We are still holding our bags in hands even after 5-10 years of playing it by law after applying for greencards. Please respect liberty and freedom and let that happen to legal applicants.

I am a July 2nd files, they told me to call on the 3rd of October. (I don't know what is the logic to calculate 90 days at the USCIS). I am trying to make the attorney call that day. May be she will have more luck. :confused:

I'm at a total loss here. My dates became current in June and I was ready with all the paperwork - even filled all the forms myself. Company and their attorneys took their own time and sent the application out only today for Monday delivery... I kept on reminding them what USCIS did to EB-3 other workers.. but all for nothing....... they can just say 'oops sorry' and out lives are screwed!!!

As I mentioned in my other post, the categorisation for I,P,C,M and ROW is based on the fact that I,P,C,M are the only countries with demand exceeding the annual limit.
ROW = All countries not hitting the 7%(or 9%) country limit. That doesn't mean they are capped at X/5. What would be the basis of that cap.
Assuming USCIS acts like it is supposed to, follows all rules etc........They start using new numbers on Oct1st of the new FY with a fresh slate of 140k available.
Now by law, they will first divide the cap into the 5 EB categories -EB1, EB2, EB3, EB4 and EB5. Now once they reach the 7%(or 9) cap in any of the categories, they will have to stop assigning numbers for that country. So for EB3, once they reach the 7 or 9% quota for I,C,M,P - they will need to stop. The rest of the countries(ROW) will get the 100 - (7 x 4) = 72% of the quota. This could be divied up between UK, France, Pak, Germany etc etc. As none of them are going over the 7%, the country cap doesn't affect them. But Since there are a lot of apps under EB3-ROW, there's never any number to spill over to the capped countries.
In case of EB2, only 2 countries hit the cap - India and China. In this case even P and M are part of ROW. But since the apps from ROW is less than the remaining quota of (100 - 7 x 2)% of the EB2 quota, the remaining will be spilled over. The spillover rules will determine who these go to.
The way the current spillover rules stand, your final calculations will still hold true for EB2 due to the spillover ultimately remaining the same to EB2. But not for EB3.

Any decent website/article/source of info will tell you that you cannot buy a house if you are planning on staying for less than 2 years.

Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

We could also do a signature/petition campaign that would focus on 'American Citizens' supporting our effort. We should aim at getting a lot of signatures. Afterall there have to be hundreds of thousands of formerly H1B holders who are citizens now; at least they would support our effort.

There is nothing called h1b jobs. There is no job reserved for someone on h1b. So to say that people on l1 are taking h1b jobs is kind of funny.
At the same time, that anti-immigrant l1fraud is here to scare people and is against the community. But because most people here are not on L1, so most people are agreeing with l1fraud user. As if L1 folks are getting ahead of us, and L1 folks are taking our jobs, same mentality and outlook as that of the disgruntled programmers at programmers guild. Maybe there is nothing wrong about that because, humans as species have always behaved as part of the food chain, eating and living on the ones below us. Likewise, people here just want to blame someone else for their problems, including delay in GCs, on others on L1. So the entire focus of this thread is "l1fraud". Now coming on to freebies,What benefit does IV provide to past contributors.I have contributed in the past, have been active at the initial stages,have spent my own money and booked airtickets to meet senators.Been a leader in a state chapter.But later realised that it was not worth for this forum which has partitions among so called donors.

Call the place where you've ordered flowers and ask for a refund if flowers are delivered elsewhere. It should be up to USCIS to recieve and then ship those flowers to the hospitals.

The 485 and EAD requires total 4 identical photos of each person. I enquired at Walgreens, but their passport photo package contains only 2 photos. Any idea how to get 4 identical photos of the same person? Moreover, the photos must be 2 inch X 2 inch. How to get photos of that size?
