Can a spouse of a person on Eb3 apply for EB2(if eligible) and then port his/her application with the EB3 PD for the family?
I doubt you can do that. Labor and I-140 (stage when you port the PD) are person-specific and not for the 'family'.

You are right axp817, but small correction.
Company A (old company) attorney filed I 485 based on the I-140 approval from
company A.
If there was offer letter from company A you can safely say that job was for future. If you did not include a letter from company A then all goes by the argument of future employment. But Finally it should be OK.

This signature waived is normal because of something having to do with when they scan the card, and if your signature is there, then it could cross the line where the machine scans your card. So I have heard from others online in these posts this is valid since August 1 FOR EVERYONE and your picture is there, so this is not an issue. What I am wondering about is why is this EAD only valid for one year when first it was valid for two years, why have they changed this? And if your i-485 green card case is pending, and you have gotten your i-765 EAD in your hand do they approve your i-485 green card fast? SOMEONE PLEASE RESPOND

I have sent letter twice. They forward it as it is to USCIS and send a reply back that it has been forwarded to USCIS for action. Then you receive a letter or call from USCIS that your case cannot be considered unless your PD becomes current.
How about you send the USCIS letter back to president again and tell him that this is not what you asked for. You already know PD is not current. The letter was for President to implement a fix A,B and C.

I haven't and don't plan to in the future to carry it in my wallet like my DL...considering where I live.
I just have my A# memorized...but maybe those who travel in Border areas or usual Border Patrol checkpoints or frequent travelers might have to.

Please consult with an immigration attorney, to make sure your stay is legal. if your i-94 expired, unless you get the revised I-94 with the valid dates, your stay is illegal. If it is more than 180 days, then you are in deep trouble. Consult with an attorney and prepare to leave.....
180 days is the limit you can stay legal even after your H1-B expires provided you have applied in time for the extension and ofcourse if your extension is not rejected.

Which country in the world would lobby another country to take in its citizens? Why would India lobby America to give permanent residence to its highly skilled Indian citizens? So that America can benefit? This would be tantamount to treason.

I had seen a similar thread for NSC->CSC->NSC filers, but can't seem to find it anymore---did anyone whose cases got transferred to CSC receive FP notice?
I am a July 2nd filer, EAD/AP approved from CSC, case transferred back to NSC back in early Sept--still waiting for FP notice for over 4 months now.
PS: I am not desperate for FP notice---and i know it's going to be several years wait--just want to get the FP done and move to an apartment with lesser rent :-)

During the Fox news channel interview of Aman Kapoor, I heard the issue of Drivers licence renewal mentioned. I have heard that people who have one year or less than one year on their work permit have difficulty getting renewals.
Is that true and if yes, is it in every state?
Has IV mentioned this issue with the senetors etc as part of the backlog and retrogression issue?
Pls. post more details if you know. It would help us to be more aware and educated about this issue so that we can address this with more details when we contact other people and our employers.

Yes this a legit reason to get receipts. But if you have been denied receipts by employer/lawyer in recent past. Give this reason a little time, if you know what I mean. Else this reason would also go to waste.
My Lawyer has been good in this regard and usually scans a copy and emails to my HR/Supervisor and Myself as soon as she get any notices/rfe's etc. I think this would be the pattern of most employers if not all.
I have my canadian PR approved and have until Octber 1st to land. I hope my lawyer will get the receipt notice by then. I don't want to lose my Canadian PR and will have to travel to Canada before Oct 1st.
I'll send my employer the proof of my Canadian PR. He kinda already knows that I have Canadian PR and have to land shortly.
Hopefully they'll give it to me on that request.

Hi All,
Its seems that my approved EAD card lost from mailbox (seems like post man delivered it in diff mail box instead of mine).. It�s been more than 15 days of approval but no card in the mail.
I contact customer service and they said wait for 30 days otherwise file new one. I am not sure what are the option I have if I won�t receive my card on time? My existing EAD is expiring within next 25 days. Is there any way that I can get my card back or USCIS issue new card without filling new one?

I don't know much about Canada PR, but the 2nd option sounds good to me. Make sure your new employer is willing to give you a Joining Letter with the similar job responsibilities, job title, etc upon which your 485 is based.

Can you please help me with this?...I have already submitted the affidavit copy and now they want it from Registrar office. Has any one got it from registrar office in India? if so, how difficult it is and what is the procedure?

Secondary evidence includes, but is not limited to , copies of: medical records, school records, census records, government-issues identity cards, religious records and/or affidavits from at least TWO persons alive at the time of birth. The oldest available evidence that lists the names of both parents should be submitted."

It is not big deal. Just ask your parents to get in touch with a document writer (guys who'll be sitting in front of Registrar offices) and they'll do it for you. Your mom and dad may need to go and sign the docs in front of the registrar.
