Dear Senator,
I am an H1B visa holder. I entered Unites States legally, studied Masters and maintained legal status for 9 years. I have worked in IT industry, contributed to US economy, paid all federal & state taxes including FICA.
I have been desperately waiting for my green card process, which is stuck in its 1st step - called Labor Certification - for more than 4 years. Even after that, I am uncertain about 2nd and 3rd steps of process. During these years, my wife and I have sacrificed many things to maintain our status and to hold onto this green card process.
It looks like my bad dream is over. Thank you for introducing a draft "Secure Borders, Economic Opportunity and Immigration Reform Act of 2007" in senate.
Now, I can discard all my legal documents, join 11 million undocumented workers, and get Z visa. Then,
1) I wont have to renew my H1B visa each year.
2) I will definitely get green card in 5 years. I don’t have to go through uncertainty of I-140, I-485, I-765, I-131 applications.
3) I can work with any US employer. And, I can obtain competitive salary.
4) I can travel to other countries without hassles of visiting US consulates and visa stamps.
To show my gratitude, I am sending copy of all my legal papers.
As soon as this bill becomes law, I will send you original of all these documents as I wont need them anymore.

Yes. my I-140 is Approved and 180 days has passed. How much time will i have to transfer H1B without loosing H1B status? Thanks for your response.
For H1B: use your vacation time to be associated with your current employer for as long as possible, try pay without leave if possible. No hard and fast rule how much gap is allowed. In principle, there can be no gap but lawyers claim 10days, 2weeks is okay. USCIS asks for recent pay stubs to check for gaps.
You are in much better shape with >180 days in AOS. Can work in EAD if needed.

Isn't the UK issue different.
They are trying to change rules retroactively. There is no such thing going on here.
A similar stance would be if in midstream: lawmakers changed retroactively that only if the job makes more then $150,000 it is qualified for EB2; only companies with revenues of over $20 million can apply for greencards. If they changed the rules retroactively in USA which would preclude people who are already in line; then you would see massive amounts of protests.
However; what is happening in UK is not the same issue here. Same thing happened in Canada a few years ago when they changed the point system and wanted to do it for people retroactively.
Here, with retrogression in the background, a lot of mess is being cleaned up and a lot of enforcements are coming in place to curb visa abuse. It is quite interesting to see how enforcements are being done and how things will be handled because on one side job market is booming, on one side you find big and small consulting doing alll sorts of things and utilising visas, on one side you see locals (Especially older people who lost jobs and find it diffucult to find jobs because of their age). Overall, it wwould bee interesting to see what will the course of action be.

Did you fill the actual I-485 forms or just the questionnaire that employers usually send? in case you've filled actual forms that they will send, did you check the box on the right bottom where it asks if you'll be represented by an attorney...
In case of a questionnaire, you might get those forms filled by them for your signatures.

My i 140 is denied on A2P issues.Ive filed MTR.Any one knows how long it takes to hear back from them on MTR.anf if MTR gets denied can i file new 140 using same old labour ?some one help please >>>

I am a typical EB worker and have all the insecurities of a person working on EAD/H1 in a distant land. Though gainfully employed seeing job losses all around makes me anxious. There is no back up if i lose my job as being on EAD/H1 does not give me any unemployment benefit, no breathing period though i have dutifully paid SS taxes without a break for last several years. With stock market tanking i dread seeing my 401K statement. Selling my House to move somewhere else might be very difficult, if not impossible.
Any setback on GC would hit me both financially ( money to spend on MTR, pay pricey lawyers , look for not so cheap health insurance, and biggest of all - loose the steady pay check )
as well as mentally ( to look for a new job, worry about same/similar classification, move to new place, unable to service my mortgage , put up with not so pleasant working conditions etc ).
I am away from friends and family so no psychological support as well when needed.

This news was actually long coming. Right after USCIS announced I140 Premium filing, they said they would consider to stop concurrent filing. This is U.S.; they are looking to mik out more $, so here you go....pay premium for I140 and feel "free" to file I485. I think that's the basic idea; lots of extra income for USCIS.

I have an email reply saying -
1) They are not going to provide a corrected W2 since they changed the payroll company starting 01/01/2009
2) The HR has asked me to report those wages even without a W2
3) They also wrote they have not received the Insurance Company payment statements which was not true because the Insurance Company did mailed those documents in the 2nd week of January and the HR also confirmed over the phone that they have received.
I have the statements from the Insurance Company that shows SS and Medicare taxes withheld. The statements also say it should be reported in the year end W2. I have also faxed the Insurance Company statements to them and have a confirmation report.
I really didn't want to file a complaint but since my wife has to receive W2 for the next year 2009 also, I felt they might do the same next year.

Applications were sent to NSC on July 19th' 2007. I got my receipt numbers today and all three numbers (I485, EAD & AP) start with WAC ### ### ####. The online status for the applications say that the 485 application was transfered to Texas Service Center and the EAD & AP applications were sent to Califorina Service Center.
Also just fyi, my I-140 app. is pending at NSC since Dec' 2006. So now I am all over the country :-) Don't know its good or bad. Any idea anyone?

Yesterday i got my receipt i check the status online the status is saying
Receipt Number: LINXXXXXXXX
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Fingerprint fee rejected and notice mailed; case in suspense.
On August 21, 2007, we rejected your fingerprint fee and mailed you instructions for how to submit the necessary payment. This case is now in suspense.
Please submit your payment with our notice as soon as possible after you receive our notice so we may resume processing of this case.
But USCIS cashed my checks i didn't know what went worng the total amount i paid is 325+70,170,180.
Did any guys get same kind of problem?
My online status is same as yours but I received FP notice and have given finger prints. My AP status online says that they have mailed me GC sometime back. If only online status were 100% correct. My lawyer says there are errors in online status so don't believe them 100%.

Unless it was a felony that requires certain jail-time or something it's not always counted against you.. remember .. purpose is not to exclude shop-lifters.. they got plenty of those in Canada but rather identify and filter out security hazards.. you might need in person interview.. but it should be alright.. I know even US immigration allows folks like that.. so can't imagine Canada being more stringent..

20 amendments is a lot of amendments. If 20 amendments bring 20 additional votes, but if 6 votes are lost due to these amendments, then I guess the cloture will still fail.
Last time the cloture motion got 45. They need 15. In getting 20 amendments, if they gain 20 -25 senators, they will also lose some. So its still not a done deal. And who knows if one of those 20 amendments is like the Byron Dorgan's bill killer amendment. That amendment to sunset the guestworkers program in 5 years is the biggest bill killer that got approved on wednesday by a vote of 49-48.

A Person needs a Valid US Visa or AP to enter back into US.
I went with a valid US Visa. I dropped my old I-94 while leaving US and received a new I-94 while entering US port (in Cruise).
