Is this just the tip of the iceberg. We know thats true in the US as well. Publicized scams/scandals are usually only an example of what goes on in general (GAFFS !!) Generally Accepted Financial Fraud Schemes instead of GAAP Generally Accepted Accounting Principles

I don't think there is any problem in EAD approval if you go out of country after filing it. I left USA the very next day of filing I-485. Still out of USA (in Canada). I already got my EAD and am waiting for AP. My attorney also said that for filing EAD, AP, 485 I must be physically present in USA.
Just to be safe maintain your H-1B status in case there is any issue with AP (because of what murthy's firm told). I can update on my AP status as soon as I hear something.

This thread is started to just gather the list of people who have approved Labor as on 31st Jul,2007 and could not file I-485 for various reasons like out of country,Not married, Employer did not file or Lawyer delayed etc.

You dont have to do anything. Just sit and watch the fun with USCIS. They will come up with solutions and get it passed with congress and they know better than any one else that they are in trouble without solutions. Lots of LAWSUITS will follow in next few months if they dont do their job on time.
If I interpret correctly you are saying because USCIS will not like to work on so many EADs and APs year after year AND SO they themselves will seek increase in annual GC numbers to clear up the mess. I wish your predictions would turn out to be true.:)
However, if enough EB GC numbers are not available, USCIS can not be repsonsibe for this. They have corrected the one mistake they did with the visa bulletin fiasco. I don't see any other basis for additional lawsuits.

I am on H-1B and wife on H-4. We did not get our stimulus payment last year since she does not have SSN.
For people who did not receive stimulus payment last year can claim it this year. So for people like me whose wives are on ITIN, can get $600 back this year or so I think. The way to do this can be:
First file Married filing separately, claim $600 credit and then amend it to file married filing jointly. IRS will not ask stimulus back. Let me know your thoughts on this idea. I wish I could get $1200 but hey even $600 is better than nothing.

Yes. my I-140 is Approved and 180 days has passed. How much time will i have to transfer H1B without loosing H1B status? Thanks for your response.
For H1B: use your vacation time to be associated with your current employer for as long as possible, try pay without leave if possible. No hard and fast rule how much gap is allowed. In principle, there can be no gap but lawyers claim 10days, 2weeks is okay. USCIS asks for recent pay stubs to check for gaps.
You are in much better shape with >180 days in AOS. Can work in EAD if needed.
Don't worry.

I think so too, the employer wants to scr** us while we are with him, but he doesn�t care a rats a** if we are not with him even if we have worked for him for years. The employer has to show ability to pay since GC is for future employment, so he simply revokes 140 to get rid of this burden. The whole system has flaws and Indian EB immigrants are the worst affected.

I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.
We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.
Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.

Ask your parents (anyone of them) to visit the registrar at the municipal office of your home town. The registrar will issue the birth certificate once your parents submit an affidavit to the office. Hope this helps.

Usually for people who dont have birth registered at birth or hospital records we have to obtain a non-availibility certificate from the local authority. Along with this certificate we submit a notarized affidavit signed by one/both the parents. Now we have learnt that this affidavit has to be signed in the presence of the registrar. Hopefully that should be ok then.

When did you file? did you labor approved?
could you give me an example, how you changed your role and responsibilities for eb2?
If your eb2 gets denied, hope you have eb3 keep running as it is right?

Hello Everyone,
Hi I am a student in United States and I was on Optional Practical Training from Jan 2008 to Dec 2008. As I finished my OPT in Dec 2008 I joined again in New course for M.S in soft. Eng.
In the month of November I got a job in California through an employer, who is based in New Jersey. As I got a job the employer asked me to sign a contract which states that I will be paid 60,000 per year and I shouldn't work with his clients for 1 year after the agreement is terminated.
As the project was only for 40 days I finished it successfully and I my employer couldnt find me another job till now. So I decided to work on my own when I got an opportunity with the previously worked vendor, when my employer came to know about this he has threatened me to sue me. Then I retrieved from the opportunity but now even my employer doesnt pay me anything. It is been 4 months, he hasn't paid me anything , even he hasnt provided me any insurance.
I asked my employer couple of times to terminate my agreement otherwise I would go to Department of Labor and claim my wages but he downplays that by saying I am not on H1B so I will not be paid unless I am working with Client. But the agreement didn't say anything like that.
I have even asked him to run the payroll where I worked .I.e in California but he ran it in New Jersey. When I pointed this to him he said the payroll will be run at the residing state if the employee works more than 6 months.
We had an argument about this but he never replies to my emails he only calls me and says whatever he wants to say but when I ask him to put whatever he has said to me on phone in an email he doesnt reply at all.
And to mention, he doesnt have any documents of mine. I even didnt fill any I9 form, what ever he has is the only agreement that I signed and social security number that I emailed him to run my pay roll.
After the argument I even requested him to send my original agreement signed by two parties. I only had the agreement signed by me, he even didnt send me the agreement with his sign on it even after repeated requests.
Now he doesnt even care to answer my calls or emails. I am really tensed. I am getting opportunities from vendor that I worked with but I am afraid he would sue me. Please help me What to do. I am really really frustrated, tensed and I can't express how I feel right now.
I want to get out of the contract and work with the vendor if Possible.
Please explain me how can I tackle this problem?

Did you communicate to him emails ? do you have a proof of what all he said in emails?
Tell him that you will write to DHS, USCIS and all American consulates in India/US/Canada..that will be end of H1B approvals for him..

What do you want to know? I130 and I485 needs to be filed. Both Counselor Processing as well as AOS allowed.
