I have been through this situation and now work for consulting company. Actually I got layed off without notice in 6th year of my h1b with Labor pending in backlog. I had no resources, tools and no one gave me any consultations, everyone told me "go find another job". In 20 days I found myself a 6 month contract assignment and had a consulting company transfer my h1b and they also applied for my 7th year extension based on pending labor from my layed off company. I went for stamping at Chennai and was through, applied for GC through EB2 PERM and got my 140 approved also and now I just got used to consulting and this is my 3rd contract position with the same company and I earn 50% more than what I was earning 5 years on my fulltime job. Now that I got used to consulting, I would want to think twice if I have to get a fulltime job offer on h1b. Everything is so customozable in a good consulting company , like moving charges, allowances, expenses, traavel expenses, can be worked out in good faith.
In general, there is an unofficial grace period of atleast a month, stretchable to 2 months based on case to case and worst comes, if a job hunt exceeds 2 months, then your new job, they may give you a h1b approval but you have to get it stamped immediately as they wont attach an i 94 with it, I have seen this happen to people.
In your case, as you already have an approved 140, you have to smartly get copies of all your documents and look for a genuine consulting company, get letterheads and keep contacts with some good friends and have them give you an experience letter and move on. You can get 3 years transfer and also retain your PD. If you qualify for eb2 in new company, then you can port eb3 PD while you take advantage of eb2 movement.
Good luck

Why was your I140 denied after it was approved? Provide more details
What did your denial letter for I140 and I485 say?
My I-140 was never approved..
there was a first RFE for my exp letters,
and then there was an enquiry against Employer
and then RFE for A2P
and after answering A@P it is denied.
while it was pending, during July07 fiasco we applied for I-485.

WASHINGTON - Key senators tentatively agreed on a plan to revive a stalled immigration bill on Thursday, aided by President Bush's support for a quick $4.4 billion aimed at "securing our borders and enforcing our laws at the work site."
Officials who spoke on condition of anonymity said Republican and Democratic supporters of the bill were presenting their proposal to the Senate's top two leaders, who in turn arranged an early evening meeting to discuss it.
Precise details to be presented to Majority Leader Harry Reid, D-Nev., and Minority Leader Mitch McConnell, R-Ky., were not disclosed.
In general, according to officials familiar with the discussions, Republicans and Democrats would each be accorded roughly a dozen chances to amend the measure, with the hope that they would then combine to provide the 60 votes needed to overcome a filibuster by die-hard opponents. The officials who described the emerging plan did so on condition of anonymity, saying the negotiations had been conducted in private.
The legislation has generated intense controversy, particularly for provisions envisioning eventual citizenship for many of the estimated 12 million immigrants now in the country unlawfully. The bill also calls for greater border security and a crackdown on the hiring of illegal employees.

"We're going to show the American people that the promises in this bill will be kept," Bush said, two days after launching a personal rescue mission.
Bush supports setting aside all the fees and penalties in the bill solely for tougher security on the border and workplace enforcement, White House press secretary Tony Snow said earlier Thursday. The president on Monday morning will make the announcement of his backing for an amendment that two Republican senators have proposed to accomplish this end.
The provision would immediately divert $4.4 billion toward border security, with that amount to be paid back once the new fees are in place, Snow said.
With many questions unanswered, it was unclear how much of a concession the move amounts to for Bush.
The White House did not have an estimate of how much money the provision would generate yearly toward border security. It also could not say whether the money would be in addition to currently planned border security funding levels or just a way to dedicate funds to that purpose. And it wasn't clear what budget account would be drawn down to pay for the initial $4.4 billion.
The aim, Snow said, is "trying to get money to the border right away."

This is something that's doable without legislation. It would be done for employment based visas.
I've been reading the posts all day since yesterday. The most plausible "PERMANENT SOLUTION" has to be this. Please read the msg from IV
1. No change in July bulletin
2. No change in August bulletin
3. Well in that case it has to be this. It would be least controversial.
Please avoid all this sensationalism in your thread headers! You don't seem to know squat and are claiming something without any reference...the red dot/square seems appropriate...why I am replying to this!?

Yes there is a security check at I-140 stage, it is not FBI name check. No one
know what this check is and who gets subjected to it or it is just random. I-140 stuck for 1.5 years without RFE makes it quite likely that your petition is stuck in this check. Take a look at this:
http://www.immigrationportal.com/archive/index.php/t-193663.html
Best way to find out is, your attorney raise a service request with USCIS.
Thanks CanadianDream. Your words are encouraging. I will check with the lawyer. The reason we want to file another I-140 is just to safeguard the H-1B status. I am in my 5th year.
BTW, I have another question. Do they do security check for I-140 also? I never know this. I thought FBI check is only for I-485. My I-140 has been pending for 1.5 years so far. NO RFEs. Nothing. Every time my lawyer calls USCIS, they say it requires additional review and since no REFs are give, adjudication should be forthcoming.
Are there anything we can do to get the status on the security check? How long usually does it take?

Is there a conspiracy, first there was delays in the processing of the EADs, now there is delay in the production of the EAD cards...
Are there more RFEs happening too?
My EAD renewal took almost 90 days to get approved, and my employer was ready to let me go if I did not get the approval before my EAD expired. Just made it with 2 days to spare.
Why every discussion has to end with donate - why donate? What IV has done so far? Where the money goes? EB2 vs EB3... etc. Stop hijacking threads.
By the way, the title of this thread is of no good. Don't give such title to generate clicks, your post is not a media news site to give misleading titles to generate clicks. "Whats happening with EAD delays" would have been more appropriate.

my LUD for I-485 did not change since 8/28 even after my FP is done.
Today I got email regd EAD that the card production ordered.
called FBI Helpdesk and she told me that over weekend(sat 9/22) then have sent the approved file to USCIS. May be USCIS is lost my file somewhere.

Same here...We received same FP fees rejected notice but checks are cashed. Our lawyer mailed the proof of cashed checks for 325 + 70. But to our surprise even before that we received appointment for FP.
I think this is common error on USCIS system. Most probably they will send you FP appointment notice. So relax..

I donot see any point in paying off the house, as you can deduct the interest to get some tax benefits. Why loose any benefit you can get.
On the other hand, use the money you were thinking of paying off the home for investments. Investments may it be CDs or stocks ( though right will come in future).
Although personally i have never bought a brand new car in US. Car depreciation is biggest loss one can take; we just bought a 5 th car...all cash paid and it is used.
Keep your cash, play with 20-30% based on your risk apt, donot pay off your home...cash is king.
On your comment of " being a novice in financial "...i have to say it Everyone is a novice in every matter, we all learn it here. Rather one who says he/she is a novice will make cautious decisions; i am wary of so called experts/gurus who mauled financial markets and still call themselves experts.

This definitely gives an incentive for people to start contributing. This is like for the people, by the people. To be able to have an organization with direct access to the USCIS in helping resolve desperate situations. But for this to continue to be in existence with that kind of outreach, needs monetary contributions from all members who are in their GC journey regardless of how safe or straight forward their case may be.

2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320.
Thats in most of visa bulletins. It would require a change in law. Removing country quota is definitely not the news announcement. However, it is a very good change in the law that is required.

Thanks for the link. I looked at it before I posted my case but I don't think it was a mistake by the customs officer. He specifically told me that he cannot stamp the date of the future I-797's expiry date (Jun 2010) and asked me to contact my local office just before the current visa expires. My current one expires June 04 2007. The future 797 is valid from June 05 2007 till June 04 2010. But my visa stamping in the passport is till June 04 2010.

The main issue is not the expiry date of the DL, the issue is why make us verify all the documents and add the 6 month validity constraint even for "Change of Address" requests, and why give us a completely different Vertical Style DL unlike the standard Horizontal style DL.
Also, I have not reached that stage, but what happens with people with EAD? You have to renew every year and can renew only 120 days before Expiry. The expiry date of DL and expiry date of EAD will keep chasing each other and at some point you will LOCKED OUT of DL because of the 6 months validity constraint...
People from other states = Do you have to go through the whole verification process even for "change of address" requests?

This minister may be the right person to initiate a soc sec. treaty between India-US like there is one between US-Canada. May be, once the US politicians see money going out they will respond to our issues.
