yes finger printing is not required, mine was issued recetly without FP. You can take a chance and send the photos. At the most they will ask for it again.

I have been hoping for EAD at least and I can happly wait for 2-3 years for my GC
if the dates are current I and my fellow non EAD holders at least can file for EAD...
If not current, they should allow to apply for 485 for the ones that they are at least 1 year far away from the current cutoff date if not 2 years (as per current bulletin, they should allow to file 485 up to October 2006 priority date), this way USCIS can borrow some time to pre adjudicate the cases, also easy for them to approve the cases once they are current.
USCIS talked about 2 step process (1) Registration and (2) Adjustment of the case by taking out the concurrent process, this was supposed to come in place last December, but postponed to this June, even we are in July, no news yet on this.........if this process comes up in place, every one can file for final stage as soon as they are clear with 140, not sure whether they will give EAD or not? Any body has updated info on the 2 step process?

Hello Everyone,
Hi I am a student in United States and I was on Optional Practical Training from Jan 2008 to Dec 2008. As I finished my OPT in Dec 2008 I joined again in New course for M.S in soft. Eng.
In the month of November I got a job in California through an employer, who is based in New Jersey. As I got a job the employer asked me to sign a contract which states that I will be paid 60,000 per year and I shouldn't work with his clients for 1 year after the agreement is terminated.
As the project was only for 40 days I finished it successfully and I my employer couldnt find me another job till now. So I decided to work on my own when I got an opportunity with the previously worked vendor, when my employer came to know about this he has threatened me to sue me. Then I retrieved from the opportunity but now even my employer doesnt pay me anything. It is been 4 months, he hasn't paid me anything , even he hasnt provided me any insurance.
I asked my employer couple of times to terminate my agreement otherwise I would go to Department of Labor and claim my wages but he downplays that by saying I am not on H1B so I will not be paid unless I am working with Client. But the agreement didn't say anything like that.
I have even asked him to run the payroll where I worked .I.e in California but he ran it in New Jersey. When I pointed this to him he said the payroll will be run at the residing state if the employee works more than 6 months.
We had an argument about this but he never replies to my emails he only calls me and says whatever he wants to say but when I ask him to put whatever he has said to me on phone in an email he doesnt reply at all.
And to mention, he doesnt have any documents of mine. I even didnt fill any I9 form, what ever he has is the only agreement that I signed and social security number that I emailed him to run my pay roll.
After the argument I even requested him to send my original agreement signed by two parties. I only had the agreement signed by me, he even didnt send me the agreement with his sign on it even after repeated requests.
Now he doesnt even care to answer my calls or emails. I am really tensed. I am getting opportunities from vendor that I worked with but I am afraid he would sue me. Please help me What to do. I am really really frustrated, tensed and I can't express how I feel right now.
I want to get out of the contract and work with the vendor if Possible.
Please explain me how can I tackle this problem?

> Experience letter non-availability as an affidavit mentioning that we tried but previous employer did not provide the letter.
> Email trail of communication with ex-employer detailing communication asking for exp. letter.
> 2 affidavits from previous co-workers detailing job responsibilities, skills, dates employed together.
> For 63 months of last employer experience, paystubs, W2's, Indian Form 16's, Indian IT returns, yearly appraisal letters, other evidence related to employment(not all but whatever was available).

With current situation in economy, I don't think our HR 5882 will be in the mark uplist. US govt has bigger problems than spending time for "recapture EB visas". I have no hope of recapture bill will be discussed near future. Sorry for my pesimistic views
As much as I am disheartened with current situation regarding EB visas, I am more disheartened by this give up attitude...
For all folks who do not act because of pessimistic views, please don't take this personally. Having pessimistic views are ok as long as they don't get you down so much so that you stop taking actions.
Lemme tell you something my friends. I came to US in 94, and for reasons mentioned in my other postings, I am still in the waiting line for the GC...Compared to me (and may be a few others), most of you guys' situation is much better in terms of the wait. But even though I am disheartened, I never lost hope and the only thing that keeps me going is trying...I may bend, but I will never break...
If you give up for something like GC, imagine how it will when you encounter bigger problems in life...My advice to you my friends is keep trying as long as there is a chance, and as long as there is nothing to lose...

The aim of participation on these talk shows is two fold- One to increase the awareness amongst the general masses regarding the problems being faced by legals as the masses are mostly ignorant about out situation. Secondly, for people who are waiting for their GC's and could be potentail members of Immigration Voice for them to join the organization. It has been proven time and again that there is strength in numbers and also the organization needs resources from it's members.
It is a logistical challange to put a program like this together with the host and the panel and IV did a good job at it with knowledgebile authorities like Stuart coming out strongly supporting our cause. Every one felt that the moderation could have been better. It is the skill of Larry King or Neil Conan of NPR that sets them apart but some times there are moderators who are very knowledgible, not necessarily on every issue but are challenged becuase of their heavy accent and other reasons.
One of the posts questioned about the publicity stunt of having a senator on the program. I am not sure if every one realizes the amount of ground work that has to be done to make that happen and must I say that all the efforts were made to get them but it did not work out finally in the end because of issues with timing.
Over all, in my opinion, it was a good program and served IV's agenda.
I would like to thank IV core team for the effort of making our immigration problems public. I could not personally listen to the show and it would be nice if someone posts a link to a recording.
In addition, I know that it may not sound feasible but I have an idea to create our own Internet radio. How you all think?

On June 13, 2007, the U.S. State Department announced that, as of July 2, individuals seeking permanent residence ("green cards") through employer sponsorship finally would be allowed to proceed with their applications. Applicants would have a short window, possibly only through July or perhaps August, to complete their paperwork.
Those intending immigrants, immediately and at great expense, rushed to gather final documents, complete their paperwork and obtain required medical exams. Many sent their applications off on Friday, June 29 for arrival on July 2 at the Department of Homeland Security, for the last phase of the multi-step process that leads to a green card.
However, on the very day the door was to open, DOS and DHS slammed it shut.
On July 2, DHS and DOS announced-based on no different information than they had on June 13 when they announced the opening of this filing door-that all applications would be turned away.
"People ask why those who come to the United States illegally can't just follow the rules," said Kathleen Campbell Walker, President of the American Immigration Lawyers Association. "But here people followed the rules and did everything right, yet without warning or explanation the door was slammed in their faces. This hoax perpetrated by these two government agencies is unconscionable, and is an example of how badly our immigration system is broken."
AILA calls on the Administration to do the right thing and keep its promise to the people affected by this sudden reversal. AILA also calls on Congress to get it right this time and fix our badly broken system.

I got my checks cashed today and got ALL receipt numbers.
485 sent to NSC whereas AP and EAD stay in CSC. All have receipt numbers starting with WAC.
I saw from the previous post that EADs are being ordered within 6 days. is that true?

I got a email and case status changed on my wife and my I485 to 'Notice mailed to new perman..."
Is this is a legit approval? My PD was current under the Nov but is not under the Dec. When does Dec become effective?
Hopefully there are some legislative changes so everyone gets some much deserved relief

I140 - approved in TSC - Dec 2006
485 mailed - July 2 07
Notice date - Aug 15th
Got EAD - Aug 23
FP: Setp 14 07
Oct - AP

I have used AC21 and have not sent a letter yet to USCIS as it is optional and that is what my attorney recommended...that is to wait for an RFE (I have changed address as I moved to a diff. state; chances of an RFE increases)
That said, I am wondering that with a G28 representation on the files with USCIS, if I send a AC21 letter all by myself (without attorney), will it be honored by USCIS ? I am comtemplating of doing this as I wanted to prempt the RFE thereby saving precious time (when date is current) and the money that I would have to pay my attorney when the RFE reaches him (I would rather he reply to an RFE but want to give my best to avoid it)
any ideas ?
