Well I had explored this option quite extensively too and
gave up my canadian PR after seeing that its not a viable option.
PR residents and canadian citizens need to get nexus pass at the border if they intend to live in canada and work in us. You need to undergo an extensive interview with US CBP. where in quite a lot of documents and neccessity are questioned and evaualted by US authorities. Also there is no guarantee that one would get it inspite of undergoing the interview. Its like acquiring a visa. If you say you had been living in US for the last 7-10 yrs and now tell them you are moving to canada because you want to work in US, that might be a problem.

Cars coming into Canada and USA are checked and custom duties applied even for half eaten sandwiches. This causes uncertain wait times and delayes
Not many IT jobs(not sure what you are) in detroit area and you need to maintain your H1 status. What if your projects ends in detroit what would you do?
There are many more issues, can't explain all here.
Bascially nexus is a good option for canadian citizens not for PR.
I am an EB3 India applicant with a PD of August 2001. Cant file I 485 due to retro so cant get AP or EAD for spouse. I am currently in 7th yr of H1 and will soon be applying for 3 yr extension for 8,9,10 th yr based on approved I 140.
I am also a Canadian PR and one option is to move to Canada. However one option which I have been researching seriously lately is to live in Windsor, Ontario and work in Detroit , Michigan.
Windsor and Detroit are both Urban areas and twin cities on each side of the border connected by bridge and a tunnel. From Windsor most of Detroit metro is only 1 hrs drive. Downtown Detroit is only half hr drive.
Here are some advantages to this.
1) You keep your H1 B visa, and US Salary.
2) You earn time towards maintaining your Canadian residency and even Canadian Citizenship.
3) You have best of both worlds. (US Salaries opportunities, Canadian healthcare/social benefits).
4) Spouse can work in Canada and keep H4 also.
5) Can continue GC process without loss of security.
6) Visit other cities in US. ie even if spouse /fly is in other city you can easily commute once a month etc.
7) Once you get GC you can always move back to US.
Disadvantages
1) Crossing border each day (normally not an issue but border gets busy on some days).
2) Paying Canadian income tax.
3) Only possible if you get transfer to Detroit or new job there.
4) If you own home etc or your wife is studying etc you may have to live separately for some time.
Has anyone done this or knows anyone who has done this ? In theory and on paper its a good idea. Apparently thousand of ppl (even non immigrants) do this both ways.
Any insights anyone can share ? This may be good option in many cases.
Thanks

Yes , the employer is Desi. who else can do something like this ?
After 6 months, can't we simple change employer on H1B and fire the previous attorney and ask him to send all the documents to the new attorney?
Can USCIS send a duplicate receipt notice to our home address on our request?
One way to get reciept notice or anything else for that matter is to file G-28 and change attorney on record. Second would be to file for Freedom of Information Act (FOIA) and asking for all the records. Here what I gathered from Murthy Chat
Chat User : When the employer sponsors and retains the I-485 receipt without processing the EAD/AP, can an individual apply for an EAD mentioning the receipt number without jeopardizing GC processing?
Attorney Murthy : Yes, a person may file the EAD with just the receipt number on the Form I-765 without jeopardizing the I-485 processing. The EAD and AP are merely incidental benefits and are not directly connected with the I-485 processing or adjudication.

Why don't you contact some senator! You have been current for so long ..
because USCIS is not even willing to talk if the Service center does not have processing dates current. And if my case is in California (which website says), then the processing dates are not current and have never been current and probably will not be current for a very long time. CSC does not process 485 applications at all.

You can enquire with the Canadian authorities if they will collect it and pass it on the US post. If not you can take a U turn once you enter Canada and go back to US to give them the I-94 and take a U turn again to re-enter Canada.

Optimist, thanks for the clarification. Do you get a 3 year extention if?
a) I140 is aproved
b) I140 filed but pending
Thx
not true. Irrespective of whether your 485 is filed or not, if your PD is not current, you can get a 3 year extension of your H1 if your I-140 is filed.
Saying this based on personal experience, and this has also been clarified by USCIS in its FAQ. Your attorney needs to mention that and ask for 3 years when the extension request is made. If they request one, they'll get one.

I see an update on jan 24 on this bill to grant 55000 visas for advance degree holders from DV lottery. Does this mean progress? Rest of the immigration bills never make it to the sub committee.
Jan 5th Referred to the House Committee on the Judiciary.

We have to help ourselves.
I for one will not be surprised. These undocumented immigrants march in thousands at their rallies [even though they face chances of deportation]. They are active in talking to media and getting publicity for their cause. They are also more actively contributing to help their cause. They have very strong backers - Agri-business, fast-food chains, restaurant owners, construction business , and immigration attorneys [ who will make lot of money if Z-visa gets passed], strong ethnocentric groups with considerable political clout, and many of them have US citizen relatives [who vote]
On the other hand, support of many immigration attoneys to EB immigration is half-hearted, high-tech employers care more about increasing H1B quota. Like it or not - IV is the only organization that is 100% devoted to EB immigration and working for our cause. Given this reality, IV should have got full support monetary and participation from 25,000 strong community here. As we know, only a minority of the community are doing all they can to help IV achieve its goal.
If we are not doing enough to help our cause, what right to we have to blame others for not helping us? In a way, we do deserve the step-motherly treatment for all the lethargy our community shows in standing up for its issues, and demanding a solution.

What happens if you get laid off by your employer right after you get the green card? That's different than voluntarily leaving your employer, isn't it?

I guess its much better for frauds to have an EAD/AP, then they can easily bypass the checking at consulates.

Eb3India,
You make very good points.
Actually a lot of folks who are beyond 6 years are themselves to blame to some extent. We did not realize that its a long process and the sooner you start the better it is.
Here's the deal. The GC process takes 4 years on average if you are from India/China. Some ppl get it it in 3 years. Some get it in 5 years. The systems is built in a way that it has to take at least 3 years. Back when labor processing used to take 2 years (1yr state + 1yr federal), the rest took 1-2 years. Now labor is really fast and the dates are retrogressed.
So, now it will take 6 months to get labor and then 2+ years of waiting for dates to become current then processing for 1 year. So about 4 years.
Off course some of us got the short end of the stick when cases got shipped to BEC's and labor took 4 instead of 2 years. and then some people are stuck in retrogression after getting out of BEC's. Its all about knowing the entire game before getting into it. I kick myself for not starting the process sooner.
So, your options are 1) Labor subs 2) Go to India and come back as L1 3) Fight the system 4) Do nothing and wait.
look I have been here for 10 years and I kick my self everyday for not getting card, if I played my cards right I should have been worrying about citizenship now :)
many of are here for good reasons of our own deed and situations which are beyound our control, 9/11, immigration politics etc. the best way to get around this either to follow some lope hole such as labor subst, L1 etc, or fight the system thru IV, or just simply wait,
complaining that someone else is getting greencard is nothing but childesh and I hate to say this as it comes from a "Highly educated" guy like who did is MS from US :D

An overwhelming majority support 485 so going by your own reasoning IV might lose more members by not supporting 485. Dont try to act too smart. Lets just support whatever decision IV core takes and go with it.
I made a one time contribution myself but I have a feeling that IV is going away from the goal of increasing EB visas and just focusing on the 485 filing. Many people that have contributed earlier feel that by prioritizing the 485 filing over increase of EB visas, IV has gone away from atleast some of stakeholders .The stakeholders were promised initially that increase of EB visas would be a top priority or atleast on a even keel with any other objectives, but now we are in phased approach.I have talked to lot of people and the feeling is same.
