Answer to Q#10 :
Country Of Birth drives priority date and not Naturalized Citizenship.
So, if you were born in India then your priority date goes by India PD no matter what citizenship you currently have.

Thank you Krishna. The question really is whether my Labor/I-140 approvals as Indian citizen can be used to continue the GC (to file the I-485) after I change my citizenship. Would you know about that?
Or, if a new GC process is restarted with a new employer, can the old priority date be re-used in the new GC process after citizenship has changed?

No I stayed with a relative in thane who dropped me to vfs in Mumbai. I did not want to trouble them, but my backup plan was to check into a hotel the earlier night. A search on google "us consulate mumbai hotel" does reveal the hotels in Mumbai. It does appear that there is no hotel in the area, most are 4-5 kms away so u do have to take a taxi too.

But doesn't Pagal PD is Feb '05. Then how could he go for " GREEN " ? EB2 right now is current for Feb 15, 2004.
just a guess, they must be pre-adjudicating - pending a visa number. So, looks like (again a guess), if they pre-adjudicate before the FP expiry date, then you are good, otherwise, they will ask you to go to FP again...

Prediction is as good as the data available. From previous discussions (EB2-EB3 predictions) - it was predicted to see movement based on the data available - well, I am guessing the data was incorrect and therefore predictions can never be close to being correct.
Sincerely hope that the efforts of this community is to seek for data that is largely correct. I guess, may be IV can ask for the inclusion of advising USCIS to release the correct data frequently in the CIR draft.

Please do not mix social issues with immigration, this is not a forum about one particular country or its social manifestations (like how do I marry?, should I stay single forever? How am I going to find a girl?). These questions are absurd from American / immigration standpoint. If you already have a spouse and have immigration issues related to those situations then yes that is valid to ask here but otherwise (But how do I get the spouse then???) is purely a social / cultural issue. Please stick to immigration issues.

Not to single you out, but why aren't people from the West willing to attend the rally?
1. Too much workload (cannot afford to take even 1 day off)
2. Cannot afford flying into DC, accomodation, etc.
3. I didn't attend the SJ rally, what will they say if I attend the DC rally;)
4. DC Rally is a waste of time, I do not support it
5. I don't have to have a green card, I can live without it, for the next 10 years!
6. I am happy to eat the fruit of someone else's hardwork, I don't want to put in any hardwork myself

I would say...do not lose heart. I hope your case gets resolved soon. My friends who have gone for stamping lately have faced such problems. Almost all of them....one in Delhi consulate, another in Kolkata and another in chennai. they got 221g and had to over stay their vacation. But eventually all three of them could make it at the end. As long as you are able to provide all the docs they ask for, you should be good.

Does it mean that these developments or should we call no developments on the high skilled immigration front in the developed countries have an underlying message for all of us? Return back to your home countries.... In USA, one positive thing was that it has been 'the melting pot' of people of all cultures and nationality to come together. I will give you an example: my friends 2 year old says that he is an American and not his native origin. In UK, you will still find 3rd generation people telling their nationality to be of their native oigin.
In USA, the immigrants intergrated with the society but in Europe, the message is clear, you are here that is ok, but live in the other side of the city and have limited opportunities. If Sensenbrenner and co have their way, US would be on the same path.

You should read that RonGothers thread - he is strongly of the opinion that maintaining H1B status while AOS is pending is useless
Its not useless if you are in a ROW country/category that is always/usually current since your I-485 can be approved in a short period of time, without having to extend H-1. So you can save yourself the hassle of switching back and forth between H-1 and EAD.
It only becomes pointless when you are in a backlogged country like most of us are. By the time a decision is made on the I-485 you wouldve already extended your H-1 beyond 6 years, thus making it dependant on that EB petition.

Today, the soft cap exists, and the numbers are retrogressed only for India and China. REST of the world is current. Hard cap would make things worse for only those countries that have higher demand and WASTE the visa numbers.

Gurus,
I need your help in this scenario. I went to India during Mar 06 and got a stamping on my passport till Jun 2010 (based on my I140 approval). But at the POE, the officer stamped my I-94 till Jun 07 as he could only stamp the date that was on my current I-797. He also told me that I can goto the local USCIS office and extend my I-94 till 2010. Is it true? and if so, how would I go about doing that??

Mr. Vayalar Ravi , Minister of Overseas Indian Affairs,is coming to USA on June 27,2006. He is coming to Washington DC on July 4 to meet Indian Ambassador and Indian community. We should try to meet him personally and explain the problems we are facing. He can talk to US counterparts and do something for us.
