Good that you have paid off your car loans. So now save for emergency instead of paying off your home loan early. Not a financial advisor but I think that's the most logical thing to do now when things are not that rosy.

The pattern of RFE's on AP's are from those cases applied at NSC >> CSC issued Receipts/EAD/AP >> 485 back to NSC.
StuckInRetro - I believe you may be correct. My scenario fits into the case you have mentioned. May be you can add condition stating people who made lot of trips in and out of US. I have made close to 9 - 10 trips...

Winner, Could you or somebody please inform the blog owner of the issue (I am not visting that site again :eek: :mad:). I lost a day due to the virus, don't want anyone else to experience that... this was a pretty nasty virus. Be warned & very careful out there guys!!
Sorry, I did not know about the virus when I posted the links. I did not have any issues both from my home computer and work computer. Anyways, as soon as I learned that some of you are having issues, I did remove the links.

I've gone through the pretty much same situation and had a hell of time
with it.
The best way in my opinion is:
1. Stamp H1B with latest approval from India(Home country) is the BEST way.
2. If you have the approval right now goto Mexico or Canada and stamp it.
3. Show the new approval letter to the POE and beg him to give the new data ( Mar 2007). ( Incase you dont stamp VISA).
4) Incase you dont want to stamp and at POE officer gave you Feb28, immediately after reaching here, do an amendment on you H1B saying
a slight change in job description. ( Like add one more thing in your responsibilites or whatever)
If he gives Mar 2007 on I-94 you are okay. If he give Feb 28 that would
create problems. I did not know it first time and found it after the date expired on the I-94. Murthy advised me to do an H1B amendment. So I had to spend about 3grands on this. Atty said technically I had some 2 months out of status stay. I travelled out after this incident. Nothing happened to
me on the way back. So I guess everything is okay.
I would recommend as clean as you could with these things, since doing business with USCIS is an ugly one.

Not to single you out, but why aren't people from the West willing to attend the rally?
1. Too much workload (cannot afford to take even 1 day off)
2. Cannot afford flying into DC, accomodation, etc.
3. I didn't attend the SJ rally, what will they say if I attend the DC rally;)
4. DC Rally is a waste of time, I do not support it
5. I don't have to have a green card, I can live without it, for the next 10 years!
6. I am happy to eat the fruit of someone else's hardwork, I don't want to put in any hardwork myself

That's why I was saying that if he did work for more than 180 days for the employer, his GC is safe. If not, it can be rescinded if the employer appeal to the I-140 denial of the labor sub. and tries to prove that the original beneficiary is a "fraud".
It can happen to anyone. So to be on the safe side, work for the original petitioner for more than 180 days. If the petitioner is a GC factory, then both beneficiaries will suffer.

Some states have the provision that instate tuition rates will only apply to permanent residents while others allow H1-B's to avail of instate tuition. I know for sure that Pennsylvania is in the permanent resident camp while Colorado allows instate to H1-B's. As mentioned previously it is the state legislature along with the commision on higher education which create the rules.
It would be interesting to compile a list of all 50 states to see where each state stands. To do that though it would help if folks residing in different states chime in. Otherwise it would be too difficult to sift through the higher education commission websites for each individual state.

My lawyer says they haven't seen any case like this before. I want to make sure before I change jobs.

Yes, there is not much we can do except for keeping our fingers crossed. Good luck to everyone who is waiting. I think visa numbers are exhausted for September. Let's hope October will bring some good news for us.

Here is the same old Cockney reply from TSC on inquiry for my wife's case through my area congressman:
TSC is currently processing I-485 visas based on filing date order. There are a large amount of cases that are being worked and your case will be worked in receipt date order. With the limited amount of visas that are currently available between now and September 30, 2009, there is no guarantee that your case can be completed before the end of FY2009. It is estimated, that in general, your case will be completed between 45 and 90 days.
Thank you for your inquiry and please do not hesitate to contact us again if you have further questions regarding this case.
Obviously that logic is bull crap, otherwise I also won't have been approved. We have the same receipt date and everything...........I guess there is so much we can do....
