Just saw a soft LUD today. No status change from yesterday though.
fundo14 - how long has it been since it was transfered to the Des Moines office? Have you called and spoken to an IO about this change?
Same here. I saw another soft LUD today 6/14 after a LUD yesterday 6/13. Wonder if USCIS works on Sat or it's just some regular database update.

Ron is a very compassionate individual apart from being a very experienced attorney.
Have no hesitation in going to him.
I have known people who have engaged him and found him to be extremely competent.
His immigration forum has been a good source of credible information, given the limitations of discussing USCIS idiosyncrasies.
Let me add that I do not know him nor have I spoken to him. However, had I been in CA, he would have been my choice.

I hope that never, ever, ever happens. Actually, I'm sure it never will. :p
I second that !
And also I don't see how that will solve anything. Visa #'s are the problem not the distribution of the #'s.

i think "same or similar" job is common sense thing to keep in mind. You dont want to specialize in software architecture the switch to building construction architecture ;) also remember that if you need an attorney to defend you, it will cost you more in money and peace of mind. So it is better to stick with what you know, if you know what i mean.
In answer to your question, no - you do not need any supporting documents from your new employer except in the case of filing an ac-21 letter which must come from your new employer.
So you can apply to any jobs that say employers cannot sponsor visa or gc because you are not technically seeking their direct support for your pending i-485 adjustment. If they ask for proof of employability, present your ead (formally called form i-766) and you should be good to go. Ead form i-766 is listed as a list a document on form i-9. See item #4 on page 4 of this document:
http://www.uscis.gov/files/form/i-9.pdf
list a means you need only present this document for employment verification. You don't even need to show any other document such as passport, driver's license, old h1-b, etc.

Hey, I have a question too
- How come people like me go red after 1-2 posts, and utter rascals here remain fully green even after redded by many?
Even though the context of your question and intention is suspicious at best....it's actually a really good question.
Let me restate it for the benefit of others
Q. How does the red and green rating system truly work?
A. The general rule that it is directly related to how much fellow members like your post holds true but there are also some finer details. Supervisors/admins can award much higher points either positive or negative. The total number of your posts even if unrated is a factor...generally unrated posts tilt the balance towards positive...which makes sense since no one found it offensive.
So becoming green is easy when the majority of your posts help your fellow IV members.
It's really tough to stay red when you have a large number of posts cause lots of fellow members have to rate your posts negatively.
Hope this helps.
Admins can chime in here and clarify if I haven't explained it right.
It's good to have a clear explanation of policy.

Are you out of your mind ? You are taking a huge risk by staying in the US and droping your Canadian PR because of some "probable" green card. What makes you think that by the time you finish school the situation will still be better in US. I hope you will not regret this but think about your family. In 3 years you and your family could be happily in BC with free health care, great weather, less stress, travel wherever and whenever you want, have your own law firm.
OR you could be a stressed H1B (a.k.a educated slave) waiting for I-140, I-485, EAD or whatever to come through.
Just because you asked, I have been in this same situation. But in my case, the decision was easy. I was on h1b making 69k. The same job in Toronto offer $55k CAD. Much less, but with my freedom to consult on the side and my wife's income we bring over $100k. We vacation in Florida for a month every year to visit friends. Life has never been better.
Whoever tells you to stay and take the risk is putting your family's hapiness in jeopardy. But the choice is yours. Just don't come here crying when CIS finds a problem with your application.
Thanks gomirage for your views as an actual Canadian resident! I have worked with several Canadians before, and while they all complained about the high taxes it seemed like they generally thought they had a better lifestyle in Canada than in the US.
However, some stuff I've been seeing on sites like notcanada.com concerns me. Is Canada really a place where it's more profitable to sit around and collect welfare than to work, assuming you can even find a job? Are Canadians more racist than Americans? Is it really hard to get by career wise and socially if you're not a native or have the appropriate connections?
I would really like to hear the views of someone having moved to Canada from the US about these issues!

Folks...it looks like I have been given membership to this exclusive club, by USCIS...:)
My status on USCIS Online case tracker shows,
"Current Status: Fingerprint fee rejected and notice mailed; case in suspense."
When I spoke with my attorney, he says, There are two options.
1. I can dispute and in turn get my processing delayed
2. Repay the fingerprint fees ($70) and forget about my first payment
Naturally, anyone would prefer option - 2.
Just wanted to share with you all...
Before I read the whole thing I thought why this guy is even thinking about it ... Know what I mean ...:) I read the whole thing and thought this guy is as smart as me ... hehe ...Good luck with everything

The FBI name check is not a side problem that once we finish fighting other problems, let's come back and pick up another problem. This is one of the major obstacles in the GC and Citizenship process which unfortunately is not transparent and there is no data available to tell you when you will pass this obstacle. If the attitude of some of the members in this organization is the delay in FBI name check is not going to happen to them and it is only random and a side problem, think again and watch out for what will be coming your way. By no means, this is not a side problem, this is one of those hidden obstacles that you don't know it is in your way once you hit it...and once you hit it, you are stuck. There is no congressman, senator or individual to help you. If we are going to be united and make the GC process transparent, we should not hand pick some of the problems that we want to fight today and come back to other problems later. You are going to soon realize how gigantic the delay with FBI name check is.
Franklin: Just to clarify, the name check effort is a private effort of Logiclife, who is one of the moderators.
Sroym: Name check not being on IV's official agenda has nothing to do with member nationalities. It is a case of greatest good for the greatest number. 200,000 people - 20% of all the green cards issued last year - are in name check. Since EB immigrants are about 20% of the total green cards, only about 40K EB immigrants are in name check. Compare that with the 250K people stuck in retrogression and 200K people in the Labor cert backlog centers.
Sroym, I understand you posted in good faith, but PM a moderator first, please, to get the facts.

You got a success story in 1 month time frame. Be happy.
The documents being asked, all are always in your hand, just keep few copies and keep sending for every H1 transfer.
Hope you are not doing H1 transfer every three months.
To make you more sad, there is a change in the process (read in murth news letter), that all the documents must be attached even if you want to make an amendment in your petition. So, you have your name misspelled, date misspelled, birth date wrong, prepare one more set of documents for that too.
Thank you.I just waned to let others knows about that you have to give two weeks notice to your current employer and join the new employer which is not possible according to the new system. Also there are lot of denials and you are not sure about the H1 is goint to get approved. At this point of time I don't think it is a better idea to start working for a company with out getting approval.Because you won't get more than one offer at this time. Also your previous employer may not want you be back.

Hello I'm from Greece.
I noticed the mentioned problem these days and I'm fully frustrated!
You can't imagine my dissapointment when I saw the pictures of a wedding in 20x30cm prints having flares and out-of-focus areas spread around.
The problem is this:
No matter the lens, no matter the focal length, the d70 produces an uneven focus area. A focused area in the middle of image, is out of focus in the edges. The focused objects near the edges are far behind. The problem is more obvious in the right edge, especially the lower half.
I made some simple tests and unhappily this was true.
I own this camera for the past 3months.
I wonder what the nikon people could do about that.
I 'm not happy to lose the camera for the next 3months... in order to send it to the service

Great..Thanks so much for your response. I will definitely consult an attorney as suggested by you, but your response gives me a ray of hope and clarifies quite a few things.
So, does this mean that same or similar job may not have any meaning? Because, now since I have an EAD, I can change my job in any field and then when my priority date becomes current, I will get my GC if no RFE occurs.
Also, does it also mean that once I have my I-140 approved and I-485 pending and also have my EAD, i don't need any kind of sponsoring or supporting documents from my new employer? I mean, can I apply to jobs that say Employer cannot sponsor a Visa or GC?
Thanks in advance.
I think "same or similar" job is common sense thing to keep in mind. You don't want to specialize in software architecture then switch to building construction architecture ;) Also remember that if you need an attorney to defend you, it will cost you more in money and peace of mind. So it is better to stick with what you know, if you know what I mean.
In answer to your question, no - you do not need any supporting documents from your new employer except in the case of filing an AC-21 letter which must come from your new employer. You also do not need to file an AC-21 right away. Taken another way, in other words, you can choose to have the AC-21 conversation with the new company after you have been with them for a few weeks and have a degree of comfort with them.
