call ur airport, I remember a friend got his I94 extended based on new I797 at the airport.
BTW- if u have an approved I797 and an expired I94, u are not out of status....when u travel next time out of country...keep current docs with u and when u reenter...the POE officer will give u i94 based on ur latest I797..

That's because my current 797 was valid till Jun 2007 and he said he can only stamp the date that is on the current 797. I guess it depends on the POE officer and in my case its unfortunate that it got messed up. Someone in the forum mentioned that he got it for 3 years. I think its very very YMMV :confused:

We went home after my wife started working using the EAD. After we came back we applied for your H1 and H4 extension and one we got that now we are in H status instead of EAD status. It is a little tricky. When we came back we entered as parolee but once we applied and extended our H1\H4 status we ar eback to H1\H4 status. Your lawyer would be able to explain it better.
My lawyer suggetsed that it is better to be in H status as it gives some manuvering time and opportunity in case the 485 is denied.

Any reason why we are all waiting for the August bulletin??? We alrerady know that the visa numbers aren't available for this year...and its also been mentioned by IV that the breaking news that everyonez expecting isnt about the visa bulletin....I am confused...could somebody throw light on this pls..why the wait?? :confused:

I will be more than happy to pay $5000 if USCIS allow me to file for EAD and AP after I-140 approval. This way, I can work where ever i want and travel whenever I want. $5000 is nothing to get this kind of freedom. What do you guys think ?

For the August visa bulletin, USCIS gave all the extra quota to EB2. I don't think this is fair for all the EB3 people. I thougt the reason they gave all the quota to them was the EB2 included NIW. But NIW is just a small portion of EB2. Majority EB2 peopole are like EB3 working for companies and not necessarily important to give all the extra quota to them. If the policy continues, our EB3 will just become fake immigration. You don't know how long we can finalize our case. Gugs, please work together and let our voice to be heard by USCIS. Hope our organization can help us.

Scythe - that would mean that the three tied entries would get around $85 dollars (150+100 divided by 3), and that seems a bit unfair considering second place is $150 and third place is $100.

Why don't you find someone who is in similar situation ? i.e. who is on EAD or on H1. There several websites that can help you : shaadi.com, jeevansathi.com, bharatmatrimony.com. Now I'm not endorsing these sites. Just providing you with some options you can look at. Man accept it - life is tough. We have to play the hand we have been dealt. Also remember one more important quote:

I got an update via CRIS
UPDATE: On August 5, 2008, we transferred this case to our NORFOLK, VA location for additional processing.
My current status: My case was filed as EB2 and the PD is Mar2006, so I am current for another 6 days (Oct 2006 is retrogressing to 2003).
I have talked to several of my friends and they said this update means an interview is in the works.
Do you guys agree?
If so, I had questions based on that. Me and my wife were planning to travel to India this December.
1) Will I still be getting an interview since my case is not going to be current starting OCT 2008?
2) In case we should expect an interview, should we wait till we finish the interview?
Any input would be appreciated.

I have been on H1B for 3000 days so far and I am still waiting for GC, (filed for 140/485 in November) and I thought I have been waiting for too long, but it looks like one of these people might actually qualify for Guinness Book.
3000 days might seem small when compared to a member's data whom I spoke with during the Sept Rally time. He has been here on a work visa since 1994 and unfortunately he had to start his greencard process several times. He was thankful that he finally got his I140 approved and filed I485 this year after such a long wait.
He was calling members and asking them to join the rally as he truly values IV and the fact that due to IV he could file his I485. I was very impressed with his dedication for IV and also felt sorry that he and his family had to endure such a long wait.

Did you join them on H1B and then move to EAD? Did you change your I-9 form when you did that? If you didn't, as far as they are concerned, you might still be on H1B and so they might feel a need to inform the USCIS. If not, well, there really is nothing in the rule book that says they have to inform the USCIS that an EAD holder left employment.

Thanks brb2 for picking up on my concern.I was afraid,not a single person would reply.This problem is going to be as bad as the BEC one if nothing gets done about it.Its so unfair and there are soooooooooo many people stuck at that stage with no hope of even knowing their status,until its actually approved or denied.Cant even imagine how frustrating that is going to be.Yet somehow not many seem worried about it.Even though i am not at that stage yet,its painful to see my friends go through it.They have resigned themselves to wait endlessly.If we can fight against the unfairness of the july flip flop,we can surely do something about this.I am sure core group has this in mind but it'll help if all members show the same anxiety!!Maybe we can bring this up along with the SKILL bill.Maybe the FBI needs more funds or manpower,watever it is,let them ask for it and get it,instead of stuffing us all into this bottomless pit!!

And to think of it so many people who could come to the rally, who are struck in the logjam and should come to the rally, did not come. It is a shame!!
It goes to show that IV represents everyone and not just Indians or Chinese. I am proud of all the Brits and other Europeans who not only joined the fight but led it from the front.
I was the guy from Sweden. I agree with the Russian student.
The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.
I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!
I was glad I showed up at the rally just to hear all the peoples' stories.
Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...
You are in trouble until you get your green card in your hand.
