Do not forget to count the effect of the fact that once congress pass FBI Background Checks Improvement Amendment to CJS FY 2008 Appropriations Bill, total load again will cross more than 650,000 (320000 + June application load +Namecheck stuck files + August and onward load) at least. So in theory Namecheck stuck guys will start popping out of the system first and then us. And this may make all bulletins till 2008 end slow not moving beyond 2003 for almost all EB2-3 categories in general. Now Senate has already passed that Amendment. Ofcourse if it will become law through passing of the bill and till then we all will have to wait. But if it is passed will be effective mostly from 2008.

I asked my lawyer same question... and she said you can port from EB3 to EB2 using same labor but employer has to withdraw approved I-140 first and this is really dicey.
Best option is to file new PERM + new I-140 and then port the PD

Based on one of the core member's request, I did the research and shared the information with IV members, so that when you get the GC, you could make informed decision.
Please be optimistic. You getting GC should not be a question of “if”, it should be a question of “when and how soon”.

I did read about a case long back in 19XX there was a brink mason who came here on an EB GC and worked for his original employer for just 1 day and switched the employer sued or may be the INS charged him (Not to clear on it) but the gist is that he got his GC and courts ruled in his favor because he showed that the work promised was not the one he was asked to do the conditions were different and hence he was not bound to work in those conditions.
BTW I think this is very relevant thread gave you some green. (Actually my green turned your status from Red to Green):D

If you are on your way to India for good, on a one-way ticket, never to come back because you couldnt get any more H1b extensions after 6th year was over and lost your H1 and didnt have EAD a la portability.
This article is a great way to convince yourself in that situation "What a bunch of SOUR GRAPES the American dream was and thank God I didnt get stuck in America but getting GC. Finally I am free to go back to India".
I guess everyone who visits this website and does not decide to participate or contribute should take a printout of this article and put it in their pocket for a little light reading on that final flight back to India. It will make it very much easy to enjoy India and forget the horrible horrible experience that 6+ years in America had to offer.

People travelling to India, especially from the West coast should fly via the Pacific. Asian airlines such as Thai, Cathay and Asiana all offer better fares, better service and faster transit times.Plus these countries are not trying to fleece people by requiring that they get a "Direct Airside Transit Visa". It happened with my family when they reached the airport to board their flight on Virgin , they were not allowed.I then bought tickets on Thai for the next day. To compound the pain, Virgin imposed a "No Show" fee on each ticket despite going to the airport. I think it would be best to avoid most European carriers, if for no other reason but they offer higher fares, terrible service, long transit times and last but not the least; the scam of the century(Airport Transit Visas). What do they think the passengers will try to do, jump off the walkway and make a run for it so they can settle illegally in U.K!I think the U.K govt is running out of ways to make money so they have found the most ridiculous way to make a few extra pounds from people foolish enough to travel on one of their carriers! DONT FLY VIA U.K. PERIOD!

At the same time, keeping everything transparent is IV's duty. IV should not wait for someone to ask these details...
Yes true, and whatever $100 I'm donating is going to benefit Ivar more than me since he's current.
It looks like no one is watching the IV video posted above. The summary is:
1. IV is a non-profit, and these orgs have very strict tax laws.
2. If funds are misused, people can be put in jail and deported.
3. Complete disclosure of strategy, investments will hinder IVs ability to campaign as anti-immigrants and our opponents are looking at our strategy to quash it. This is especially true with lobbying.
4. Previous years annual reports are available.
Facebook or Google are not going to publish their daily funds usage report or they will be out of business in 1 month
The reason I'm asking for donations is - Without thousands of members donating, we cannot successfully lobby for Green card laws for us.
Its not directly going to benefit me, I'm still a long way off.
The person in the video is not me.
