Prediction is as good as the data available. From previous discussions (EB2-EB3 predictions) - it was predicted to see movement based on the data available - well, I am guessing the data was incorrect and therefore predictions can never be close to being correct.
Sincerely hope that the efforts of this community is to seek for data that is largely correct. I guess, may be IV can ask for the inclusion of advising USCIS to release the correct data frequently in the CIR draft.

Does any one know how mant days it takes to get denail notive .I-140 denied on April 22 and says notice mailed but didnt recieve yet .Both emploter and attorney havent recieved any thing yet .Is this Normal ?
You should call USCIS to let them know that your notice is still not reached to you, so incase if it's stuck on the way, they could send another copy.

Hello gg_ny,
It is too scary.. Plz note that the surname change is after mariz.. As per our convention, after mariz, wife's surname changes to that of husbands.. We have the mariz certificate with us.
Is this still that major problem, as earlier explained by you?
The problem as I it was traveling on your old passport after you obtained a new one. You could have travelled on the new one attached to the old one and your change of name document.
I concur with others...you need to sort this out fast before you land in trouble. See an immigration attorney quickly. My 2 cents.

I have similar situation - I applied for 140 in July 2006. My daughter will turn 21 in July 2007. As I have applied for 140 before she turns 21, she is safe for GC, but will loose H4 status when she turns 21. As per my lawyer's advice I have applied for her F1 so that she can stay and continue her studies in US. When I become eligible to apply for 485, she can be included in the application - but, not as a dependent of H1B holder.
The date of petition - Is it the date one applied for the Labor Certificate, or the date of submission of I-140 petition?

Thanks for advice. Yes my last M.Sc. and Ph.D. from the USA.
Could you please clarify what "find out NIW holders in your / related engg field"? How can I find out?
Do you believe EB2-NIW is easier than EB1-OR?
Thank you,
John
You cannot apply for EB1-OR on your own. Only EB2-NIW and EB1-EA can be self-sponsored. If your employer applies for EB1-OR then it might be easier than EB2-NIW since you don' have any citations. To find out "NIW in your own field", talk to your adviser ... he might know other students who applied. You lawyer might have handled cases in your field. No citation is not good but hard to quantify what is a respectable number of citations. A few hundred might be okay in one field but maybe a thousand in another field of research/work.

Hi Friends,
I am a permanent employee for "x" company, my 140 filed on May 1,2007 waiting for approval, 485 filed on August 22,2007 not been approved either, we just got our EAD's, also please note that i am on 6th year extension on h1... my company "x" moving all projects to the different company "y" from December 1, 2007. ie we are all moving to "y" with the same job title just everything is same istead of "x" it is now "y" company.
When i called my legal department and ask them about green card status they simply said nothing to worry... everything will be moved to "y" company, as a transition exployees..
Be honest with you guys...from the last 4 days... i could not sleep... i really dont know what to do in this situation, this is the reason.. i am seeking your help. can some one guide me or answer below questions please.
1. 140 filed 05/01/2007 - 11/30/2007 more than 180 days with "X" company
2. 485 filed 08/22/2007 - 11/30/2007 more than 90 days with "x" company
3. EAD approved
4. Travel documents approved
5. I am on H1 6th year extension.
6. Transition employee.
my question is
1 Can my green card status remains the same and continue the process with the new "y" company ?
2.Do "y" company has to start processing labour/140 again ??
3.Is it doable that moving everything from "x" to "y" including GC processings ??
Thanks in advance...Kindly help me out in this situation like how to proceed from here
With sincere regards...
Desy
Can undrstand your anxiety and hope things will workout for you.
But your details are sketchy...what do you mean by all the projects from your current company are being moved to another company: is the new company Y is buying your current company X. Then you might be OK. I remember reading somewhere that - in case of a merger your application for I140/I485 will not be disturbed if the new company takes over all the assets/debts of the old company. Search in these forums on company merger (more on other popular forums) and you will get more info. Understand the agreement between the two companies (your current X and new Y) - if its a straight forward acquisition (taking over assets and also debts and all previous agreed upon contacts) then you will be fine - I know because I have been thru an acquision during a pending I140.

Thanks for the responses so far.
To the bro who suggested I rather stay here than go back..well I work as a consultant thro a vendor hence that is not an option (thanks to the new memo).
Given the market is so hot in India right now and here new policies are made to make our life tougher, only makes one's consideration to move back stronger.
I will call up SSN office today and check out how much more is remaining of the 40 Q for me...will try and do that.
On RONR, I will find out and post here when I have any confirmed updates - but one thing I know for sure is:
Tax year starts on april 1st in India. If one stays atleast six months starting that date, he is still considered NRI. Hence say if you deposit 40,000 USD in SBI on may 20th...and return after october 10th, you are okay. No tax in that year..but if you came back before the six month, then there is some tax that you have to pay.
NON - RESIDENT STATUS UNDER THE INCOME TAX / WEALTH TAX ACT:
Condition Status
1. He is not in India for 182 days or more during the relevant previous year. >> If yes, then he is a non-resident.
(so check the next condition.)
2. He is not in India for 60 days or more during the previous year and he is not in India for 365 days or more during the 4 years prior to the previous year. >> If yes, then he is a non-resident.
RESIDENT BUT NOT ORDINARILY RESIDENT (RNOR)
Condition
Status
1.
He is not a resident, as per the above provisions, for at least 9 out of 10 previous years prior to the previous year under consideration.
>>
If yes, he is RNOR
2.
His stay in India during the 7 previous year prior to the previous year under consideration should not be 730 days or more

I am in the same Boat. My PD is May 26 2004. Mine and my wife's case was transffered to Des Moines Iowa on March 19th 2008 and says its for additional processing. I applied for EAD renewal on June 11th and no approvals yet. I called uscis and they say that my ead would not be approved until the additional processing on my 485 is completed.. I am guessing it would be an interview.

Question is what happens if I decide to withdraw the H1b App
Or just change the job .. will then still then keep RFE alive?
If my employer won't give the wage reports etc. today.. he's definitely not going to give me that even in future then..
'GC_ASP' is trying to say, "USCIS may open ur I140 and send an RFE for ability to pay..."

What is interesting is that 2 days before I received the CPO email I also received FP notices which is scheduled for first week of Nov. So I am confused whether or not they really approved my I-485.

I don't expect to get a 1D-II lower than the MAP price before 2004 year end.
If Paul's hunch that we'll see the 1Ds' successor by September is correct, then we might see cheaper 1D-II bodies prior to that.
As for the Kodak, it certainly has the resolution, but it doesn't seem as if it's generating much enthusiasm. The 1Ds (with less pixels) OTOH has. Removing the very expensive anti-aliasing filter was probably not Kodak's greatest moment.

In the present situation i believe it would take around 1.5 years to 2 years if you start by preparing for labor and by the time you get your labor and new I-140.
If you ask me about audit, its better i don't scare people, i started this porting process in Jun 07 by applying labor and it got audited after a long wait it got denied, my lawyer filed an appeal and we waited for 10 months still no answer so we applied for withdrawal even that took long time and finally applied for new labor in Apr 09.. so don't get scared it doesn't happen to everyone.. maybe 1 in million case :)
Ivar, thanks for the info. I am thinking of applying for porting now.How long does it typically take to process. Also was there any audit you are aware of that came for your case?
I do not have master's degree but I have 10+ years of experience and my job requirements are also for managing a team etc.
